News: Fox: Tony Romo arrested in Milwaukee for OWI

Yeah, this is definitely cops taking it to the extreme. There was nothing initially that appears like he isn't in control of his faculties. The test results don't look bad especially for some with back injuries. Bet he gets off. Not sure if Wisonsin is a state that you automatically get your license suspended if you don't blow. He was respectful and tried to follow all her instructions.

This is how I understand it. A breathalyzer is just one piece of evidence. You could blow a 0.0 and still be charged and convicted of a DUI based on other evidence. But each state has slightly different laws.

If you know you're not drunk, it's a good idea to comply. If you are drunk, I don't think refusing the test will help in any way in most states. To me it looks like Wisconsin is more lenient than New Jersey for example.
Yep....it can all be a bit confusing. Especially when you're in different states. Under influence or not....natural instinct is to not give the state evidence against yourself. Easy say when you're not in it.
 
Not sure what bodycam video some of you guys are watching, but he looks pretty buzzed to me. I defended at least 200 of such cases over 30+ years, and it doesn't take very long at all to get to a 0.08 BAC...in other words, you don't have to be stumbling drunk. In the event of a breathalyzer test refusal (which triggers an automatic license suspension in Wisconsin and any others with whom that state which may share driver information), officers can still proceed with an arrest based on other evidence (odor of alcohol, physical appearance, failure of field sobriety tests, etc.). As for the handcuffs, that's SOP...no matter who you are.

For a guy in Tony's position, with the means to easily arrange for alternate transportation after time spent at the 19th-hole or wherever, there really isn't any excuse for getting behind the wheel. Very unfortunate mistake; we've all made them in life.

He's entitled to a presumption of innocence, and we'll see where the case goes? He'll certainly have first-rate representation. Just glad no accident was involved.

Remember, the officer smelled alcohol and Romo reportedly refused to take the test........those two will get you arrested every time, regardless of the state you live in.
I have no idea if he was impaired or not, but the rule of thumb, which is understood by both the police as well the citizenry, is that you can beat the charge but you can’t beat the ride.

He did a one leg stand for 20 seconds.

Tony always looks buzzed,thats just his face.after watching the video of his traffic stop i can say without doubt that he wont even get a slap on the wrist for this.

He was smart to record everything with his phone.
Yeah, I didn't think he looked that bad either. Could have been buzzed but if I didn't know him or that alcohol might have been part of the equation, I'd have just thought he was a slower talking guy. But we know he does talk faster than he did there. At least on air. I do wonder about the calling your lawyer thing and whether he was in his legal right to want to do that at that point.

Wicnosin PD should drop this imo,the only way they can prove he was drunk is a blood test and i dont believe Tony did a blood Test.This video gives zero evidence that he was drunk and stopping for passing on the right is just petty .

I guess I’m just comparing to what he was as a player and it didn’t look too off based to me. Unless he was drunk his whole career.

In fact, it seemed more like she was just connecting his playing golf to "oh then you must have had drinks if you were golfing because that's what golfers do." It made Romo do a double take too. I would definitely seize on that if I was his lawyer.

He seems a little off but I’d personally chalk that up to being nervous. Just never know how those encounters can go.

Field sobriety tests are notoriously fallible and it’s why it’s usually a bad idea to submit to them.

One in three stone cold sober people will “fail” FSTs and even if they are completed to perfection. At the point you are taking the tests, you’re probably going to jail regardless of how you perform, refuse roadside breathalyzers also as they are notoriously error prone.

Even the EBT at the jail can throw false positives

bottom line, don’t answer questions, assert your right to remain silent, don’t make small talk, be polite, refuse tests

AI says that people do it to avoid handing prosecutors hard evidence of intoxication plus the stuff Kwyn said above and that leaves it just to the police's judgement, which can be hazy. Like I just mentioned, I didn't hear the cop say she smelled alcohol on him, just ask if he had drinks and then made that curious comment about playing golf and not drinking. That's the kind of haze a lawyer would love to debate.

smelled alcohol is out of the cop playbook. Along with slurred speech and glassy eyes... all subjective crap. I just saw him taking the tests. He didnt refuse anything.
