LOL, you said it sounds like he was driving dangerously. THat is an assumption. You said she must have smelled alcohol. That's an assumption.

And if a cop asked me to get out of the car for field sobriety tests....I would probably want a lawyer's advice too. Those are very much in favor of the police. Nobody impaired is going to be able to stand on one foot for 20 seconds like he did.
Everything we are mentioning here is an assumption, is it not? He got pulled over for crossing a white line, that is a fact. The cop had enough reason to believe he may be OWI; that is a fact. I did not make this up; it's a fact. I have watched enough cops shows, and live in Canada to know that if cop asks you to step out of your car...you do just that. Impaired, or not impaired is not for me to "assume", it's for a cop to determine
 
I never said he was being arrested.

I took a USCCA class. When you deploy deadly force inside your home...They tell people call 911...1st...then your lawyer immediately. You've not been arrested yet. Don't say anything else. At this point, most LE is NOT your friend. They will arrest you. And record anything you say.

I would think LE would allow that call if you are otherwise being co-operative. I'd also have my license registration proof of insurance handed over. Not sure if that happened yet.

Calling a lawyer shouldn't bring up any more suspician. Hands are up, window down. I know LE has to be very vigilant and cautious...but you make it sound like they MEANT to look for something...more suspicious. Fine...it is what it is.
I dunno man, you guys in the U.S. act far differently that we Canadians do. A cop tells you something here, you do it...rightly or wrongly, if you don't your suspicion rate jumps to 100%

The HGN test is absolutely subjective

There’s no report, no video that can pick up the misculue eye movements and the results are completely at the officers discretion

Flashing lights, medial conditions like HBP, ear disease and vertigo, the officer not following the rigid guidelines (she didn’t) , caffeine, and sometimes, just a persons natural eye functioning, can all lead to a false positive.

Head trauma can permanently cause changes to the eyes that will throw off a HGN.

The min you choose NOT to follow their instructions puts them in a defensive mode immediately and you're probably not going to like the outcome. It's just the way they trained, wired or programmed.
 
I agree. If I had Romo’s money and was already set for life. I would probably just tell the cops. “Charge me with whatever you’re gonna charge me with and I’ll let my lawyer handle it from there, let’s just get this over with”
Yep. Because I’m not going through all this crap if I don’t have to.

Here's what you don't understand. There's a list long of physical tests, blood tests, breathalyzer, set distances, fixed clues, Time, etc.....None are 100%, but that's not how it all works. Which you aren't qualified to make a judgement on. Next you'll blame fatigue.

Fatigue has absolutely resulted in convictions

What you don’t seem to understand is that the entire process is subjective and built to secure convictions. It’s not built to prove guilt or innocence.

Every single factor is trumped by an officers “subjective impairment opinion”

Hell, they’ve even coined a new term to use. “Analogous Substance Impairment” or “Novel Psychoactive Substance”

Both are essentially the same “we think the defendent was under the influence of a heretofore unknown and undetectable chemical”

The thought that a human is not going to be susceptible the normal human frailties were all subject to because they are wearing a badge is just downright crazy. That 3 month stint at the academy turns them all into advanced beings devoid of all those pesky human traits the rest of us mortals suffer with.

Then folks saying the same thing repeatedly since then.

It is not hindsight when I said that was an extremely unlikely prediction that will come true. It wasn't gonna happen.

It is 2026.

Romo, for whatever reason, just does not seem to understand the nature of a Traffic Stop. He just interrupts and says whatever pops in his head.

Romo is a naturally gregarious and friendly person. He made the mistake of believing that the encounter was something other than a series of events that would almost inevitably lead to him being jailed.

Personally, my layman’s opinion is that he appeared to be impaired, but honestly most police officers are far from expert themselves

A police officers playbook and actions when they executing a traffic stop are scripted.

It’s not much different than when you talk to a level 1 tech support person at a call center.

Their goal is to successfully complete their step by step script so they can clock out.

Once that’s all done, the prosecutor simply has to ask the officer “was it your opinion that the subject showed signs of impairment?”, while nodding their head “yes”.
