One-time football star who spent six years in prison for rape has charge dismissed after accuser contacts him on Facebook to say it never happened

A high school football star who was once one of the most highly-sought players in the country has had a rape charge against him dismissed after his accuser admitted it had never happened.

Brian Banks, 26, who spent six years behind bars in California, collapsed in sobs during a court hearing as a prosecutor quickly conceded the decade-old case and moved for a dismissal.

It came after the woman who accused him, Wanetta Gibson, added him as a friend on Facebook when he left prison with a tag. In a message, she explained she wanted to 'let bygones be bygones'.

Nice job criminal justice system. You let an innocent kid who would've most likely made the pros sit behind bars for a crime he didn't committ.

I'd never heard the story before it was posted by someone on FB. I truly hope she AND her family gets what's coming to them.

They destroyed this dude's life.

sure, it was malicious prosecution on her part, she forced him to do that by bringing a bogus charge.

I agree he should, just wasn't sure being that he plead out...

She is a COLOSSAL ******bag... she's in big trouble...
 
I cannot begin to tell you how awful and elated at the same time I feel for this kid. Awful that he has endured this. Elated that he is being exonerated.

I hope someone gives him a shot. I really do.

On the other side of this, he cant sue her. Whats he gonna get? So like someone else said, after doing a plea, can he sue the state/govt whatever?
 
Uhh what was her motive to do this? Just to get to the stage where she had a chance to sue the school for money? I mean that was still a long shot with there being 0 evidence against him. Was she just spurned by him or something?
 
What a horrible miscarriage of justice. His accuser ought to be sent to jail for AT LEAST the same length of time he spent in jail, plus a day. No early release. No time off for good behavior. This is so bogus.

If Norv Turner/ the SD Chargers are giving him a shot... and I have no reason to believe they aren't, I think that's awesome. Hope he sticks and becomes a success if truly innocent, as it appears he is.

Update, 4:30 p.m.: Bill Johnston, director of public relations for the San Diego Chargers, says "there's no interest in this time" at letting Banks try out for the team."No one here had even heard of him until this story came out until this story came out today," says Johnston.Cold world.
 
This story makes me angry. That woman needs to be tried for false accusation, but no matter what happens, that young man has lost opportunities that only few can dream of and six years of his life for nothing. His lawyer didn't do his job and took easy way out too. :mad:
