Legal liability question

It has come to my attention that the wife's ex has been getting paid under the table for years in order to avoid garnishment of child support. IMHO any company willing to do this is guilty of fraud. My question is this: Is the company not also guilty of aiding and abetting?

The money isn't the issue. It admittedly would have made life a little easier for the last fifteen years, but we raised two of his kids without his help. I am just infuriated that a man can not file taxes for 15 years, avoid his obligations, and that a decent sized company has been willing to help him cheat the system... and two innocent children that should have had some more of the better things in life.
This is a side note and in no scenario should the kids suffer the consequences.
And courts dont care who left who...
But since this is in an open thread I have to ask; did she leave him?

I hear you, Dex.
But that is an entirely different scenario.
One guy earned real money and hid it, so by law should have paid.
The other didn't have income (even if it was due to being a slacker). Hard to squeeze lemonde from a rock.

This guy did wait tables off and on, he earned enough money. The problem is that their is no paycheck to take from, his tips are/were paid out in cash every shift......which is common practice in the restaurant industry. When he did work, there was not anything to garnish wages from because servers get minimal to zero dollar paychecks.

What is worse is that he still has 50% custody even though my sister is the sole provider. The courts said one does not have to do with the other and is a separate court battle. 8 years of no support payments yet he can still come and go as he pleases and my sister can not say no.........or else she is the one in trouble. Our judicial system is whack :(

Oh, as a side note...I do realize they are two different situations but in the end, it is still fighting a losing battle. If that company is doing something illegal, it will take a lot of time for the IRS and whoever else to sort it out. When that is finished, then you have a few other departments/agencies stepping in for the domestic issues which will also take awhile. They(state)may or may not ask for past child payments to be paid. Even if he is lucky enough to get a favorable outcome, that father may not even have the money when it is due.

This is a multi-year process which will cost all parties a decent amount of money.....hence; a losing battle even if it is a win :(

Sadly, that's how our system is. If you have weight to throw around (money) you can get away with a lot of stuff. Its virtually impossible to collect what youre owed if its less than $25,000 and have it actually be worth it.

I had a guy jip me on buying my two Cowboys PSLs and being that the dispute was over $10,000 no lawyer would touch it with a ten foot pole.

He abandoned them when she was pregnant with the second kid.

To reiterate, the money isn't needed anymore. It's a lot though ( in my world anyway) approx 80K.

Classic deadbeat. Ugh

It'd be on thing if he was totally out of the picture....but it does sound like he has no vistation rights. With support comes vistation privilage, usually.

Some moms just want the "dad" out of the picture entirely, and especially if she has a new life and husband. Sometimes the clean break is better for family and kids. Sometimes.

He's definitely gamed the system.

You have the trump card now.
