unless they changed the rule on this even if the spot is wrong and they move the spot of the ball if it doesn't result in a first down (yard to gain) then the challenge is lost and the team loses the time out.

Not sure which team it was last year challenged the spot, the refs agreed the spot was wrong and respotted the ball but it wasn't enough to get the first down so they lost the challenge, and their Time Out.
