Well, I'm keeping my fingers crossed. I called the Animal Control officer just now since he was already out of office last Friday afternoon when this happened. I described my situation and he already knew about the case. He told me that this won't fly and that he would probably demand the owner keep his dog in a kennel at all times. He also acted genuinely concerned and I appreciated that.

He told me he would let me know tomorrow what happens and took my number down. I told him I didn't care if the neighbor had five pits. But the problem was the neighbor hiding the dog and denying he lived there and not checking on my family. He told me I should get some pepper spray. I told him I bought that a long time ago and got this stuff.

I did offer him a year's supply of Commander jerky but he said no and that it would be tasteless, stringy and give him gas.

Seriously though I haven't yelled at him or called his name out. I realize this can work on some dogs but you don't know this one.

I understand I don't know this dog. but i'm just trying to give some advice that could help you and your family be safe and save you guys some money whether it be on a 6,000 dollar fence or Lawyer fees. you have to try to establish your dominance over mr Cujo. next time you or your family is in your backyard and he's at the fence barking or growling, not necessarily yell but in a stern voice like you mean it say "Cujo no!" or "Cujo go inside!". and while you say that to him walk towards him cause when doing so your showing your dominance. all the dog see's is fear from you and your family cause every time he's around you guys run away from him. with that he senses your fear and that makes him scared himself. show him your not afraid of him and if anything he should fear you. I know this may sound funny or stupid but give it a shot. I've seen it work and have had it work for myself in a similar situation. only difference was the dog in my situation was a 200 pound rotty and his name was Zues. so give it a try and let me know how it goes. you're smarter than any dog so don't let it dictate the way you and your family live.

I have turned towards it and put my shoulders squarely in front of it and it got angrier. I have walked towards it confidently with a stern voice and it got angrier. It goes from angry when I ignore it to outright kicking its backpaws and hunkering down when I face it with my shoulders straight and looking at it. Oh he knows I don't fear him. But he seems keen on trying me out. He would lose anyway. If he comes over the fence, my pool is close by and he cant grip my leg or arm very long underwater along with his eyes gouged out by my thumbs. He would also have to deal with some 440 Stainless. :) I wouldn't ever harm the dog however unless he enters my property and threatens me or my family.

than you need to find a way to get at the owner. the owner is the problem. I knew that when you told me the dogs name was Cujo.

Rowdy, what about putting up security cameras facing both their back yard (with your yard visible), and the front of your, and their house. If the dog gets out again (hopefully, this wont happen), you will have video proof of it. You can inform the neighbor that you have this setup (just dont tell them where, in case they want to sabotage them), and maybe they will take better care of keeping their mutts in check.

I'm not sure what city you live in, but in most Dallas suburbs, they take stuff like this very seriously. We have some kids in the neighborhood that have a pitbull, and while walking it one day, it got loose, and ran straight at me while I was changing the oil in my car. The dog was huge, and pretty intimidating looking, but turns out, he was just a big goofy pup.

EDIT** I just read the entire thread, and noticed someone already mentioned setting up a security cam. I would do this. Get one that has audio too, and you can set it up to record to a dvr. As stated througout the thread, DOCUMENT EVERYTHING! I'd even go back, and get the officers name, and a copy of the police report if they have one. Hopefully, the situation can be resolved before before someone gets hurt.

I never complain about the crazy high property taxes I pay.

Worth every $, and weeds out this garbage. I have 3 cats and a really cool german spitz. But would not tolerate a pit threatening my family....

I told him that I would take him to court over the issue that I cannot peacefully go into my own property without any confidence that his dog is retained properly. I also stated that I would have almost a zero chance of anything going my way since his dog hasn't come over the fence yet and attacked me or anyone in my family. I relayed to him that at least if it went to court, there would be some documentation about this event in case it really did happen. I also wrote the letter to basically warn him on paper that this was an issue that has been ongoing for about a year since he moved in.

Well, the pitbull got out and attacked my daughter in our front yard last Friday. She's ok and was quite lucky to have not had its teeth into her. She had her school bag swung around in time to have it put its teeth into part of her clothing and her school stuff. I heard her scream out and I opened the front door and she raced in. I didn't know what happened until I heard her scream out. I called the police and they came out and as they were on their way, one of the neighbor's "friends" quickly took the dog away and drove off. I told the police what happened and they walked over to the house and talked with the owner. The police came back and told me that the dog my daughter described was very friendly and he petted it. I told him again that the dog that attacked my daughter was briskly taken away before he got there! I also told the officer that the neighbor has three dogs total and the two he saw were other breeds from his friends that stay there and were very friendly dogs.

The officer then told me that when asked, the neighbors told him that those are the only two dogs that had been there! So I called my daughter back out there and she described the pit again and then the officer said "well youre changing your description now because before you said it was brown/white and now youre saying its dark brown/white" WTH? I'm thinking, "Uh, we are victims here and you are acting like this didn't happen."

I usually keep my cool around the police but at that point I walked away about fifteen feet and turned around and said, "I can't believe this, you are not doing your job." He then said, "Sir, get back in your house." So at that point to not give him anything to use against me, I stepped into the threshold of my house and stared back at him as he went to his patrol car and left.

He had some girl cadet with him and smiled at her as he was getting into his car and left. I then got the wife and family into the car and headed to the police station and asked to speak to a supervisor. Luckily the one I saw behind the dispatch glass was the supervisor who gladly came out to hear our story. He apologized for the officer's behavior and took a report down for us and acted like he wanted to do something about this. So here we are. I have a neighbor that not only had his dog get out just like I thought would happen and reluctantly did nothing about it but lied about the event, took the dog away for the night and has never asked and probably never will if my daughter was ok after his pit attacked her. As far as he knows, his dog could have done significant damage to her as he never saw what happened except for the screams I'm sure and the dog just getting out and having to put it back inside.

I need to do something about this and hit hard but not sure what to do. I still do not see how this would do anything in court since there were no breaking of the skin. However, if sound waves are an offense for disturbing the peace, what about disturbing my family's peace with a dog attack and the ability to live a peaceful existence in my house and on my property? If she had gotten mangled, then the court would understand her mental anguish over it. However she is horrified to be outside now. I don't want anything from my neighbor other than fully knowing that this won't be an issue anymore. I am not seeking anything other than that. Something has to be done about this because if it happens again, I am not sure what I will do.

I don't know how anyone has replied to this, so if it's a repeat forgive me: You have shot the mutt in it's rotten face.

Attacking your daughter is cause enough, regardless of what some pencil pusher with a badge thinks.

You're neighbor is a POS too; disregard also his opinion on the matter of his dead dog.

Buy a really good piece of steak. Trim off a strip. Go out of town and buy some liquid rat posion. Marinate the strip of steak with the poison for a full day. At night, toss the strip of steak over the fence. The next night, go out and grill the leftover steak and celebrate a safer neighborhood.

That may be a little macabre, but I certainly wouldn't hold it against you.

Glad to hear that your daughter is ok and I hope you're able to get this resolved.
