Local authorities in Columbus didn't have the technology to extract the metadata from cell phones during their investigation.

Now that that information had been discovered, could they reported reopen the case?

Zeke could have bigger problems ahead.

It all comes down to the NFL believing her because like some here THEY WANTED TO BELIEVE her to professionals realizing that a proven liar should not be believed at all.

They cannot prove that any of her bruises DID NOT COME FROM the fight she had with that other woman. YET they DEMAND that Zeke prove he did not hit her. How do you do that unless you have24/7 video of her for that whole time period?

You really want him guilty. And by the way quite often the truth is NOT in the middle like you claim.

One other thing. The NFL claims they based this on "evidence".

However, they dropped a little contradictory nugget in their letter to Elliott. They casually talk about the credibility issues of the girl but gloss over it citing that the detectives told them that they did not believe she was lying.

So essentially, they took the word of the detective over the actual evidence surrounding the credibility of the woman - signed affidavits, text messages and witness accounts that show the alleged victim clearly made up the last night's incident claiming Elliott had ripped her out of her car.

So when the "evidence" ran counter to the outcome the NFL wanted, they glossed over it and tried to explain it away with nothing more than an opinion.
Hiding exculpatory evidence is the exact reason the DA dropped charges against GHardy... his attorneys found evidence of blatant lying allowed at the Bench trial by the DA and as soon as they reported it the DA dropped the case..

The NFL does not care about the truth....... they only want to win the PR battle..... they want other people like the NFLPA to defend these 'monsters'

The metadata is the NFL thumping their chest to make it sound like they did something that the prosecution didn’t do. This is evidenced by that doofus Peter Harvey taking the time to explain how police forces don’t have access to it.


This is a he said vs. she said case. Regardless of what a doofus, incompetent Peter Harvey says..there are no eyewitnesses to Thompson’s accusation.


In a he said vs. she said case that doesn’t mean it didn’t happen. But, in a he said vs. she said case the credibility of both sides becomes critical.


For instance, if EE told them he was NOT in Columbus on the 19th and they can prove he was and the metadata shows that the pictures were taken on the 19th in Columbus…it would hurt EE’s credibility. HOWEVER, even with that said the metadata would still not prove that EE actually abused Thompson. It would just show that the pictures were taken on the 19th and in Columbus and when EE was confronted he would have lied and that makes you wonder about his credibility. And if the DA could get some more information, then you could start building a case.


But, none of that happened.


EE never denied being in Columbus on the 19th. So his credibility is in tact on this one.


Meanwhile, Thompson lied to police and tampered with a witness. She could be seen as completely non-credible at this point.


Doesn’t mean that there was no way EE could have abused her. But it’s a he said/she said case and credibility becomes paramount and she has none.


One of the things I wonder is if the police confronted Thompson about being in a fight with that woman at the bar. If she denied or neglected to point that out, it just further damages her credibility. The NFL nor the DA ever addresses this point. I feel that her actions on the 21st show a hostile and violent person and given her past of lying about stuff, she could have very easily gotten in a fight previous to the 19th with some other female since she has the tendency for doing so and that could explain away those bruises.


But the metadata argument is ridiculously weak and insulting to our intelligence.

If he went to trial and was not found guilty, then they can't re-open the case because that's double jeopardy.

But this never went to trial (or even made an arrest).

I was wrong edited. Double Jeopardy law was to stop the police and DA from trying to re-try a case in front of new judge or jury with nothing new to add and trying to get a guilty conviction.

Good question . The NFL decision definitely doesn't shine brightly on the DA's decision to drop the case but it's much more complicated in Columbus prosecuting a home town hero.

The bigger point is a violation of the NFL Personal Conduct Policy doesn't require a conviction or a guilty plea to determine there's conduct detrimental to the league.

The physical evidence that a violent act involving domestic violence with one of their players is basically all that's needed.

Fans are getting entirely too caught up in the legality which is really not as much factor to the NFL decision.

Conduct detrimental to the league doesn't require an illegal offense as we've seen several players suspended without prosecution or a conviction .

We've even seen players suspended without an unlawful accusation like deflating footballs or coaches suspended for Bounty which is another offense not illegal.

The NFLPA signed off on this policy which allows wide latitude to interpret enforcement by the NFL.

I think we can conclude that any Domestic Violence accusations involving a NFL player , coach or associate where physical harm can be measured with a photo or video the NFL is going to act in order to protect their image.

If they don't huge fallouts could arise from activist groups which could even challenge their Anti trust exemptions to Congress.

This is no longer just about football. It's business!! As always follow the money trail.

Looks like some fans who were not supportive or didn't see enough evidence or cause of the suspension initially have been influenced now that the NFL has rendered their decision and looking for more closure from the DA to affirm the suspension.

I get what you are saying and completely agree that is what the NFL is counting on. However, there are but few things worse in life than being labeled a woman beater. It is a label that will follow this young man around for the rest of his career and beyond. It's a horrible, horrible thing to be. IF they wanted to come out and say, we have looked at all the evidence and we feel that as a cumulative punishment, we are going to suspend you for 6 games for all your bad behavior, the speeding tickets, the pulling down of a woman's shirt, possible altercations with a woman, etc. I think they would have a better case here. But they have branded this young man a woman beater with 0 proof that he did it. Now, i am like everyone else, I do not know if he did it or not but I do know the accuser has been proven to be a liar over and over again and once you lie about one thing, you can't be trusted on anything else. So to just take her word and label this young man a woman beater is just a horrible way to do business. I don't really care about the 6 games, it is what it is and quite frankly, he probably deserves to be suspended for his actions over the last year or so. But in no way should the NFL be allowed to label this young man a woman beater without very concrete proof of such a thing. IF I am Zeke and I didn't do it, I would never take a reduced suspension without the NFL apologizing for using that term and make it clear that there is no proof that ever even warranted such a label in the first place. With out that, I would fight this forever and a day.

I certainly don't view him as women beater. I think that attitude would reveal the same lack of knowledge in how and why the NFL rendered its decision which is not based on any guilt determined by the law.

This was about conduct detrimental to the league which politics and image of the league plays an important factor in the decision. Always follow the money trail.

Well to be fair it seems you are not only rooting for Zeke to be suspended, but also to have the criminal case reopened based on the NFLs crappy investigation. The fault in the case that caused the DA to decline it are still there. This case will never be reopened. I promise you that. I'm not an attorney by any means, but my father in law is a DA here in Utah. He looked over it for me and said that no da in the country would take on this case. It's a 90% chance losing. He said the only way one would take it is if it we're a new guy looking to make a name for himself by charging a high profile celeb. The Ohio DA isn't that. My father in law is a die hard Giant's can as he practiced there for 35 years, and even he thinks the NFL botched this and is in serious trouble. Bottom line the court case will never be reopened!
