What shocks me is how fast you get hearings down there, it is almost like the lawyers involved have no other cases

Remember, before anyone panics: the material FACTS of the case do not change on an appeal. New *evidence* is not being introduced in this appeal.

Kia Roberts' findings were NOT included in the final report. She was NOT present at any of the key meetings held to make decisions about Elliott's suspension.

The NFL really, really has a tough row to hoe here. They have to convince the appeals court on the merits of the EXACT SAME EVIDENCE that Judge Mazzant saw that Judge Mazzant got this case 180 degrees wrong and that Elliott must be suspended right the heck now.

I'd be shocked beyond belief if there is a reversal here.

The NFL was hoping not to even have oral arguments. They wanted the 5th Circuit to simply rule by this week or next. At least it means they aren't buying the whole case isn't ripe argument without hearing from both sides in person. Doubt this case ever sees a NY courtroom.

It's just about an emergency stay of Mazzant's restraining order.

If the 5th circuit upholds the RS, which is likely, there will be a full hearing. And that process will take months.

Zeke probably plays the rest of the year
That's what I thought.

Then if they want a hearing, that means they don't understand the NFL's case here. That doesn't bode well for the NFL.

That's not what they will argue. Their only argument is that the case was filed before Henderson ruled.

Filed where? It's not primarily an appeal of the process of how Mazzant ruled, it's a jurisdiction hearing. The NFL will argue this case shouldn't even have been heard in Mazzant's court, should have waited until Henderson ruled, so then the NFL could have picked it's own court in NY.

Mazzant already laughed at them heartily for attempting this argument to him, the 5th Circuit is going to follow suit.

Yep.

It's interesting that the 5th Circuit wants to discuss this matter. It doesn't mean Zeke is at risk here but it would definitely fall into the category of this not falling into the category of good news for Elliott.
