BS..... they specifically said Mike had a water in his hand in the lobby. One can go out and have some drinks with friends and then turn to some bottled water .... something those of us in our 50s often do, as we have gotten smarter than we were in our 20s. Thats exactly what they said here.
What about him telling the radio guys that's the reason he can't remember what happened? Is that bs?
If this goes to trial, you can bet Marriott's lawyers will know where he had been and what he'd had to drink before coming back to the hotel. And if he did not have enough to cause blackout or memory loss, the sand will drain form that bag. If he did, then he still has the problem of proving he did not say what they said he did.
Irvin is the one that opened the can of worms about drinking and that will be a strong focus of the defense in this.
And so far, there's been 0 mention of his regaining his memory. He was either too drunk because just a couple of drinks will not cause memory lapse or he is lying and using that as his excuse for not remembering.
Put yourself on that jury. He's suing them yet he cannot state his case to the fact he did not say what they're saying he said. How in the hell does that play to a jury?
