I have said from early on that fundamental fairness should be the whole crux of Zeke's fight. As it is a bedrock of any legal system, it would be hard for any judge to really ignore it.
The NFL pays a lot of money to lawyers and I doubt they are incompetent enough to go down this road unless forced to by the NFL. The NFL thought that the Brady case gave them a blank check to do what they want. Goodell and company are the ones that got this idea that basic rights could be bargained away in a CBA and that has NEVER been the case. IF that was the case then you could have slavery, etc as long as you sign a contract. Some rights are NOT up for negotiation.
