There's also the possibility that he woke up drunk from being out partying...It was Miami and partying until 6 or 7 in the AM is pretty standard...Driving while drunk, on the other hand, is not

Stallworth had been drinking at Liv at the Fontainebleau Hotel before leaving to go to a home in Miami, where he arrived around 6:15 a.m.


It's unclear if the home is Stallworth's residence. Stallworth owns two condos in downtown Miami and one in Midtown Miami, property records show.


An hour later, he drove his black Bentley east on the MacArthur Causeway, where he struck Mario Reyes, 59.

The pedestrian's negligence has nothing to do with it in Florida. If the driver is over the legal limit and driving under the influence, he/she is responsible for whatever happens. That's why you don't drive under the influence.

I know of a case in Florida involving a judge's brother who was an atty and he was driving over the legal limit and he hit a pedestrian who stepped out in the middle of the street at night and the pedestrian was drunk. The judge's brother is in prison today finishing up about a 10 year sentance.

They don't play around in Florida. Stallworth is in BIG trouble.

I'm sure he was. He left around 7am...he didn't start at 7am.

I lost someone close to me because of a drunk driver.

I'm not saying Stallworth was in the right. Three illegal activities happened:

1. Stallworth blew a .12BAC, which is really not that much at all. however, it's still over the limit and illegal.

2. minor speeding. 50 mph in a 40 mph zone is really not fast at all.

3. jay walking. maybe it sucks as a law, but it's still illegal.

now, it's really not hard to see Bently HIDs in the dark coming 50 mph down the road. maybe if the "victim" hadn't been an idiot and looked both ways(like we're all taught to do), maybe he'd still be alive.

P.S. - for what it's worth, someone close to me, AND HIS TWIN BROTHER, died because a drunk driver was driving the wrong way on a highway.

seriously though, jaywalking is still illegal and 10mph over the limit constitutes just a warning(don't know how it works in Texas though). take away the DUI(which .12 is nothing crazy) and have a normal traffic situation. if you look both ways and can't see the brightest headlights on the road today coming your direction, then you're a complete idiot.

have you ever been in an accident? hell, I hit a squirrel today while I was perfectly sober. do I feel bad about that? I sure do. but I can't feel too bad, since the squirrel ran in front of me.

then there's the scnerio of someone trying to kill themselves. say a depressed guy jumps out in front of a guy that blows a .09 BAC. is it really the "drunk" guy's fault?

Wasted? To blow a .12 the average person would drink three and a half drinks in two hours. That's hardly wasted.

That's not true. The average person adds .02 to their BAC with each drink, and the average body disposes of .02 in BAC each hour.

For Stallworth, who weighs 200 pounds, it would take him 6-7 drinks just to get to a .12 BAC. Then depending on how long he had been drinking, and how long he had stopped before driving back home.... His BAC could have been going down. If he stopped drinking say an hour or 2 before the accident (which was at 7 am), then odds are his BAC when he stopped drinking was probably around .16. That's about 8-9 drinks for a guy his size.

I don't mean that to sound like I think you're a stupid person in everything, that's my fault for saying it in such a way, but that I thought it was stupid in this instance.

I don't think you're a bad person, or whatever, based on one comment. Like you said I've never met you and it's just not my style. it's just one particular thing that I don't agree with you on and think is stupid. :p

Well based on this logic, it is your view that if somebody is not actually in a crosswalk, but is jaywalking, you can mow then down with your bentley and drag them down the street???

When the police ask me what happened, I am going to say "the dude was jaywalking, not my fault I mowed him down with my Bentley", "I even flashed my lights at the dude before I made a speed bump out of him".


Jeez........I would really hate to have some of you guys as my defense attorney and tell the judge its ok to run over somebody jaywalking............WOW:eek:

He had time to flash his lights to warn him but did not have time to hit the brakes and stop?

That is really odd. You know how someone will walk acroos a parking lot in front of you about as slow as possible and your mind is thinking this stupid idiot deserves to be hit - well maybe you have never had that feeling - but anyway...

That is what this feels like to me, Donte saw him crossing, had the opportunity to stop, and in his drunken mind decided he was if that sucker was not getting out of his way he was plowing him over.

It does not make a lot of sense.
