RENO, Nev. – Law enforcement officials in Nevada have no intention of opening a criminal investigation into allegations Pittsburgh Steelers quarterback Ben Roethlisberger raped a woman at a Lake Tahoe hotel-casino a year ago, the sheriff's department said Wednesday.

Douglas County Sheriff's Deputy Teresa Duffy said the accuser would have to file a criminal complaint to trigger an investigation into the incident the woman says occurred during a celebrity golf tournament last July while she was working as an executive casino host at Harrah's Lake Tahoe.

"The victim is the only one who can do that," Duffy told The Associated Press. "Unless there was a third party that actually witnessed the incident, which according to the civil case, was not the case here," she said.

What does this say? I have seen cases prosecuted with a hostile victim before. :confused:

There's a difference in prosecuting it and the police investigating it. The police typically don't get involved until a report is filed.

I'm with cobra on this one... any plaintiff in a civil suit who thinks they have a case waits for a criminal action to be resolved first. If a defendant pleads out or gets convicted at trial, you have a slam dunk win because of the different burdens of proof. This is putting the cart before the horse to try to make a quick buck (or I guess a few bucks).

That's why the civil suit by the Goldmans and Browns against OJ waited so long. If he had been found guilty they would have had a walk.

No civil suit was ever files. She admitted later it was a lie.

I think there was a police investigation that quickly determined it was a bogus report.

Despite canceling a press conference that had been scheduled for today in conjunction with his upcoming appearance on Shaquille O'Neal's ABC reality show, Steelers quarterback Ben Roethlisberger will make a public statement later today regarding the civil lawsuit filed against him last week in Nevada.

According to the Pittsburgh Post-Gazette, Roethlisberger will make a public statement at the team's complex at 2:00 p.m. EDT Thursday.

But he will take no questions.

The last part makes sense. Anything he says can and will be used against him in the lawsuit. So by addressing the situation in any way, he possibly will be telling his accuser's lawyer something that the lawyer doesn't already know, and Roethlisberger also will be putting on the record something that it would be very difficult to contadict while testifying under oath during a deposition or at trial.

The first part, however, makes no sense to us. Does it really serve his interests to wag a finger and say, "I did not have nonconsensual sexual relations with that woman"?

It's better to say nothing and do nothing beyond the confines of the legal process.

And if he's making his statement pursuant to the "if you're innocent you shout it from the rooftops" strategy, then he should go the full distance and answer questions, too.

Because ESPN is in bed with Roethlisberger. Had this been an athlete who doesnt care about ESPN, like TO, this would have been a lead story.

To the trained eye, Ben's statement means nothing

We've finally had a chance to watch, rewind, watch again, transcribe, watch again, re-read, and watch again the Thursday afternoon statement from Steelers quarterback Ben Roethlisberger.

Here's the video, and here's what he said: "I did not sexually assault Andrea McNulty. Saturday was the first that I learned of her accusations. Her false and vicious allegations are [an] attack on my family and on me. I would never, ever force myself on a woman. I'm gonna fight to protect my family and my reputation. I'm not gonna discuss my private life or this civil case in the media. I'll respond to her outrageous allegations in the appropriate forum. I have an obligation to our fans, to my teammates, to my coaches, and everyone in the organization to remain focused on the Pittsburgh Steelers. And I will do that. The allegations against me are reckless and false. As much as I'd like to answer everyone's questions, I'm gonna respect the legal process. And I'm confident the truth will prevail."

On paper, it sounds good. In large part because we're certain it was written by lawyer David Cornwell. (As we once said regarding a statement issued on behalf of Pacman Jones, the chances that Ben wrote any of those words are roughly equivalent to the chances that he drafted one or more books of the Bible.)

Roethlisberger's delivery likewise left something to be desired. Do you remember how many (including us) criticized Mike Vick over the mere possibility that he used notes while speaking "from the heart" after he pleaded guilty? Watch the video of Vick's statement, and then watch Roethlisberger's.

Of course, what we think doesn't matter. The intended audience was the legion of Steelers fans throughout the country. Whether or not they're swayed by the performance remains to be seen.

But there's a chance that, someday, we'll all look back on the video of Roethlisberger's words with the same universal smirk that arises upon viewing the classic TV moment of which today's appearance reminded us.

It seems I remember that thing being on 24/7 for quite a few days on ESPN but I only recall it being on one day that it turned out the lady admitted to lying.

See...I don't mind if they report on these situations but you don't have to run these things 24/7 for days upon days and then when they are proven to be guilt free just run it for a day or something.

That always did bother me how that thing played out and it seems even funnier with the idea that now that it is Big Ben and the steelers they basically try to not report on the situation at all for days.

Crazy stuff.
