They used to treat the majority of concussions like that, but if I am not mistaken they rwalized it made the recovery tougher.

Maybe we're reading too much into this. Maybe the head injury isn't that bad. Broaddus said Gathers is "pretty banged up right now". Maybe he's past the concussion but still has a sore neck, back, or something similar. The Cowboys are always super-conservative with injuries. The season opener is still over two weeks away and I think we'll all have to wait until the roster cuts begin to know the truth.

If he goes on the IR before that he has to be waived first and if not claimed then he can be added to the IR but he wouldn't be able to return

There is one loophole that he could return if he makes it to the IR in the preseason

If they reach an Injury Settlement he would be a FA and could re-join the Cowboys 6 weeks after the scheduled return date

But that is not what they are talking about because he would still have to be waived first
