Decatur Municipal Court Clerk Jessica Haggard said Tuesday that Judge Bill Cook Jr. declined to push back the trial set for Friday on charges of resisting arrest and disorderly conduct. McClain’s local attorney, Carl Cole, had filed a motion to reschedule because the Cowboys start camp on Thursday.

Haggard says the case had been postponed three times since McClain’s arrest in April 2013.

I thought Jerry handled this under the table (LOL). Oh well. Last I heard McClain was fighting back (figuratively). And I say that's a good thing .... if you feel you were on the right side of things.

You're thinking of Henry Melton... Different guys. Different issues. Melton's issues have been resolved.

According to WHNT-TV in Huntsville, Ala., McClain was with an estimated group of 700 people at a park located in his hometown of Decatur, Ala., when police ordered the crowd to leave, witnesses said. McClain refused to do so and began cursing at the officers, the witnesses told the television station.
"The officers got out and started moving everyone out of the street, when they heard someone from the crowd start yelling 'F the police,'" Decatur Police Lt. John Crouch said on WJZ-AM in Baltimore. "They continued to move people out of the streets when they heard it again. They eventually identified the person in the crowd. They moved in, told him he was under arrest for disorderly conduct, at which at that point, he tried to jerk away."

Is disorderly conduct even a legitimate criminal offense? I always thought it was some petty offense that they just slap you on the wrist for, maybe throw you in lockup for a night .

After some quick research, apparently it can be considered a criminal offense if it's a misdemeanor. Ridiculous that saying "F the police" warrants a jury trial.

I would think he's contesting the charge. Otherwise, it seems like he would pay a fine and be done with it.

Of course, I'm no lawyer, I just play one on TV.

If that's true, the problem I would have with it is they also have a resisting arrest charge. Even if he can get the disorderly charge dropped (class c misdemeanor), resisting arrest can still be punished. If he has a way of paying this off before the court date he should take it.

There are two types of resisting arrest convictions in California and thus there are two different types of penalties for each conviction. A person can be convicted of either misdemeanor resisting arrest or felony resisting arrest. The misdemeanor offense can be punished for up to one year in jail and suffer a fine of up to $1,000. The felony offense can be punished for up to three years in prison. Prison is not the same thing as jail. A jail is typically less heavily guarded than prison and is designed to house inmates who have been charged with a less serious offense. There is also the potential for more freedom of movement and greater privileges in a jail.

Ouch. Obviously, a great deal will depend upon the severity of the decision that is handed down. A few days and a fine would be the most advantageous penalty for McClain and the team. The longer the delay and with possible jail time being included in his sentence, it could surely have serious repercussions. In the meantime, we'll be left waiting and hoping for a minimal extent of punitive action to be forthcoming.

He will be in camp by Monday. He will pay the fine for disorderly, cut a plea of a misdemeanor guilty charge along with probable community service to avoid jail.

He will then hit up the local Sizzler to celebrate with friends and family. He will then be seen off as he boards the plane to L.A.
