Next time I get a DUI and crash my car and kill someone, I get a big paycheck from Jerry Jones? Because that's what trying to happen right now. It makes me sick.. Almost to the point that if he does rejoin the Cowboys. I think I'm done.

You know, it really won't matter. This team is mediocre (as usual). There will be no playoffs and maybe, just maybe, Jason Garrett will be gone.

They are worth 3.2 billion. Jerry wanted Johnny Dopey for glitz and glamour. That is what matters.

This is the first time in a long time I am not looking at the season with excitement. The offseason is better. Draft Day 2015.

I feel the same way but I prefer to not be a Debbie downer.

I believe Josh Brent will receive a minimum eight (8) game suspension. Aldon Smith’s suspension and NFL policies factor into my opinion. First, Aldon Smith’s situation:
NFL Media Insider Ian Rapoport reported Smith has already appealed and lost. The breakdown of the suspension is four games for substances of abuse and five games for violating the personal conduct policy, per the agreement negotiated, according to a source informed of the decision.
Next, the policies:

Drug Policy

Page 1: This Policy applies to all players who have not formally retired from the NFL.

Pages 20 & 21: Discipline for Violation of Law Related to Substances of Abuse Other Than Alcohol… A player will normally be subject to discipline up to and including suspension without pay for four regular and/or post-season games for a first violation of the law related to substances of abuse other than alcohol and for six regular and/or post-season games for a second violation of the law related to substances of abuse other than alcohol.

Discipline for Alcohol-Related Violations of Law or Abuse of Alcohol… If the Commissioner finds that there were aggravating circumstances, including but not limited to felonious conduct or serious injury or death of third parties, and/or if the player has had prior drug or alcohol-related misconduct, increased discipline up to and including suspension may be imposed. Discipline for a second or subsequent offense is likely to be a suspension, the duration of which may escalate for repeat offenses.

Personal Conduct Policy

Pages 1 & 2: While criminal activity is clearly outside the scope of permissible conduct, and persons who engage in criminal activity will be subject to discipline, the standard of conduct for persons employed in the NFL is considerably higher… Persons who fail to live up to this standard of conduct are guilty of conduct detrimental and subject to discipline, even where the conduct itself does not result in conviction of a crime.

Discipline may take the form of fines, suspension, or banishment from the League and may include a probationary period and conditions that must be satisfied prior to or following reinstatement. The specifics of the disciplinary response will be based on the nature of the incident, the actual or threatened risk to the participant and others, any prior or additional misconduct (whether or not criminal charges were filed), and other relevant factors…. Unless the available facts clearly indicate egregious circumstances, significant bodily harm or risk to third parties, or an immediate and substantial risk to the integrity and reputation of the NFL, a first offense generally will not result in discipline until there has been a disposition of the proceeding

Third, the Brent timeline:
  • December 2012: The fatal automobile wreck
  • May 2013: Brent tests positive for marijuana /arrest warrant issued following month
  • July 2013: Brent retires from the NFL

NFL spokesperson Greg Aiello: "With his retirement, there is no action for us to take at this point,"

  • January 2014: Brent sentenced to 180-day prison sentence
  • June 2014: Brent released from prison

Summarily, I think Jerry Brown’s death constitutes an egregious circumstance that resulted in significant bodily harm for Brent’s best friend. The personal conduct policy does not specify set punishment durations but the previous definition may equal two games at the very least. Additionally, Brent was convicted of a crime involving alcohol. Before the conviction, officials verified Brent tested positive for marijuana. The combination of alcohol and subsequent marijuana use could tack on six more games for violating the drug policy. Just my opinion.

I'm not sure how to feel about this. I'm not sure it's a good idea. As for him paying his debt to society, and being allowed to play again.....

This happens all the time. Folks return to work. I know the NFL is not an ordinary job. I know it's a privilege to play in it. But it's also a privilege to be a US Congressman, and the people of Massachusetts had no problem electing Ted Kennedy over and over.

I'm all for Brent trying to do whatever he can to get back into the NFL and earn a spot on a team.

This whole thing where Jerry is guaranteeing him a roster spot (essentially kicking someone else off the team), without even seeing if he can play or is in any kind of shape, it just really unsettling. I feel like we're gonna have this precious roster spot taken up all season without getting any kind of real production from Brent. I almost would prefer that he gets a 1 year suspension so that maybe Jerry wouldn't be so eager to hold a roster spot for him. He needs to earn his way back onto a team.

So are you trying to tell me that if you or I killed someone in a DUI and went to prison that our jobs would be waiting for us when we got out? Even better, they would fire someone so that we could have it? I don't think so. He absolutely has a right to work. He just shouldn't have a guaranteed spot back at the same position that enabled it in the first place.

Who has said he has a guaranteed roster spot?

I think what the organization has said is they would welcome him back on the team..

..they haven't said what the conditions for his return would be..have they?

I missed that..if you know differently..point me to the article and I'll correct my thoughts.

The NFL isn't a jobs program, it's a lucrative and exclusive guild that employs the best of the best in their sport. Nobody has a "right" to play in it.

You're right, nobody has a "right" to play in the NFL....but Brent has a right to try.

If Jerry is guaranteeing him a spot, haven't heard, but that's another sign of poor leadership.

Decent retort- although on-the-field performance is not THE end all be all for a team (although it should be the most important).
There are other considerations when it comes to players also like if the person will fragment the locker room, or will said person's off-the-field irresponsibility affect the team.

Otherwise I agree that he should have a right to try.
I think his past should handicap the decision though.

Now, I don't recall any repurposing to another role, concerning the 53 man rosters...but after earning a roster spot for three seasons, and contributing, a player should at least be given the opportunity to try for his old spot, when he's still young.

Good post, but as far as Brent is concerned, you can go back further.....he has had problems with substance abuse prior to the NFL. Got multiple chances to clean up his act and failed. Was part of the supplemental NFL draft due to his substance abuse and look what he did in the NFL.....this is not a one time affair....he has had numerous opportunities to clean up his act but never did....now it killed a kid...its not his first mistake nor his last.........has he even began treatment???.....can not believe they will let him play football without receiving some type of treatment....Jail time was not treatment.....playing football does not cure Alcoholism.....he needs help not the NFL ....

Perhaps he has begun a treatment program on his own, but he must be officially reinstated by the NFL before its drug policy mandates he enter its treatment program. His pre-NFL career legal and substance abuse problems directly effect Brent but will not apply to what the league decides. League policies apply to his professional career only.

It's always interesting how people see things differently. Both Ray Lewis and Vick did horrible things and we're let back in the NFL. Heck Brent made a mistake, being stupid, and has to live with losing a friend his whole life. I'd say he should at least be given the same chance as Lewis and Vick!

They aren't people I give my admiration too either. They are both despicable.
