Fans should know CBA rules for contract negotiations

Many fans saw the appearance of Jerry Jones on Michael Irvin’s podcast today. Saying he had “an offer on the table for Micah Parsons” with sizeable numbers.

JJ saying all that is a total waste of time and a complete misrepresentation of how NFL contract negotiations are to be conducted according to the NFL’s current Collective Bargaining Agreement (CBA)

For example, if an NFL player has an NFLPA-certified agent, (which Parson’s agent David Mulugheta certainly is) then all negotiations must go through that agent. Period. Teams are forbidden from contacting or negotiating with players who are represented by an agent without the agent's presence.

Jerry knows this! Clubs can face penalties for violating this rule, including the cancellation of any contract offer or signed contract made outside of these rules.This rule protects players by ensuring they are represented by their agent during negotiations, helping to prevent situations where a team might pressure a player into a less favorable deal without their agent present. (Imagine that)

So if we hear Jerry or Stephen say that “we had an agreement last March”, it is a completely invalid argument. Apparently meant to win in the court of public opinion in hopes that many Cowboys fans should buy that. Don’t buy it. It’s invalid.
Agreed Bob, however if it went as I have heard where Micah then told Jerry to contact his agent and make it happen, if Jerry did that, which it sounds like may have been the case, then I think Micah and more so his agent are just being difficult.

Great answer. I love the star. Hate the owner Its that simple. I been a cowboys fan since the early 70s. I won’t sit here and stroke the Jerrys ego. The truth is we have become a joke to everyone in the NFL. We were once the standard bearer every other franchise idolized. Not anymore

So all the other teams that have NEVER won a Super Bowl (there are 22 of them) are they also a “joke to everyone”? Why aren’t they all screaming about the GM?

I think the relationship is already damaged and beyond the point of no return.

Right or wrong Jerry feels as though he had an agreement with Micah

Micah says he does not want to be a cowboy and he wants to be traded.

Give him his wish trade him for draft capital we can use for when we need to replace our quarterback or build our defensive line to stop the run.

Micah is not Randy White he's not Bob Lilly he's not Charles Haley he is nothing but small when it matters.
Get rid of him and the drama and get fresh young players on a rookie contracts.
Randy White, Bob Lilly, and Charlie Hailey played with great players around them on defense. Micah plays with a bunch of chumps.

Article 48, Section 2 of the NFL Collective Bargaining Agreement provides:

“The Commissioner shall disapprove any NFL Player Contract(s) between a player and a Club unless such player: (a) is represented in the negotiations with respect to such NFL Player Contract(s) by an agent or representative duly certified by the NFLPA in accordance with the NFLPA agent regulation system and authorized to represent him; or (b) acts on his own behalf in negotiating such NFL Player Contract(s).”

The purpose of Article 48, which deals with certified agents, is clear. Its ensures that if someone other than the player is involved in negotiations, that person must be a certified NFLPA agent. It was drafted to prevent teams from having to negotiate with players’ brothers, uncles, or friends who were not qualified. But nothing in Article 48 restricts a player from acting on his own behalf just because he has an agent. Subsection (b) explicitly confirms that a player always has the right to negotiate directly if he chooses.

That is exactly what Micah did in his conversations with Jerry. He acted on his own behalf without his agent. And that conduct is fully consistent with the CBA. In fact, it’s been common practice around the league for years: players often handle initial discussions themselves and then let their agents step in to review or finalize the contract. Jerry and Bill Parcells did it with Tony Romo, and the Patriots were well known for negotiating directly with players before bringing in the agents to formalize the deal.

I reviewed the CBA, and Article 48 is the only provision that comes close to addressing your assertion. And nowhere in it does it say what you’re claiming, i.e., that all negotiations must go through the agent if the player has one. On the contrary, it says the exact opposite: a player can always negotiate on his own behalf.

So I’ll ask again: where in the CBA does it say that a player who has an agent is prohibited from negotiating for himself directly with the GM? Because the language of Article 48 doesn’t come anywhere close to saying that.

Yes. This rule applies any time a player’s contract is being negotiated. Future or current contract.

For example, an agent has to be involved in a current contract when restructuring is done. Obviously for future contracts, an agent must also be involved. A negotiated NFL player contract without a player’s certified agent involved is a violation of the NFLs collective bargaining agreement.

We still like to think of us as Americas Team yet we have won nothing in 30 years. We can’t toot our horn and have nothing to show for it. Those other 22 teams have never been as great as the cowboys once were.

I love this team but hate what it’s become all because of Jerry’s need to be in the spotlight
