Fans should know CBA rules for contract negotiations

Lol. Jerry has no idea what he is doing. Micah going to get paid top dollar by Cowboys. Watch. This is the Jerry show. All the publicity is all he cares about
:omg: Jerry's franchise legal team is well paid and very good. Stephen sees to contract rolls as they develop.

Coach gets what he wants...

The owners negotiated a new collective bargaining agreement with the NFLPA because they wanted more money, while they were still under contract by the previous one. Negotiating while under contract and before the current one happens all the time in all aspects of labour "disputes". Jerry knows this. The other owners know this. The NFLPA knows this. Yet the fans still fall for it.

All this talk that Jerry spits out about Micah being under contract is complete garbage. Jerry saying they had a deal in place in March is such BS and I for one am glad Micah is standing up to this clown and telling him to shove it up his a**.
Sounds like micah pivoted off their gentlemen's agreement once the agent saw the details and told them to shove it up their buttocks and now jerry is bitter about it.

It is funny that micahs agent is the first billion dollar agent and jerry hates him.

Could it be that the contract sent over benefits the player more then the agent and that is why it has stalled because agent needs a bigger pie off of micah payday?

To your last point about the deal being stalled because the agent “needs a bigger piece of the pie off Micah’s payday”…

The amount of a player’s contract that goes to the agent is set by an agreement with the NFL Players Association (NFLPA) An NFL agent receives a maximum of 3% of a player's contract with a team as established in NFLPA regulations for agents.

With endorsement and marketing deals, however, the commission can be significantly higher, typically ranging from 10% to 20%.

That is part of the negotiation process. Not unethical. No matter the final contract, it has to be signed by the player.

The agent has to be involved prior to SIGNING.

You don't have a knowledge of elements going into a contract. No matter what, it has to be signed by the player. The meeting of minds is with the player and then signed by him. How he so chooses.
Holy crap. I'm sort of defending Jerry (while holding my nose) and agreeing with CCBoy in the same thread.

What has become of my life.....

lol

Many fans saw the appearance of Jerry Jones on Michael Irvin’s podcast today. Saying he had “an offer on the table for Micah Parsons” with sizeable numbers.

JJ saying all that is a total waste of time and a complete misrepresentation of how NFL contract negotiations are to be conducted according to the NFL’s current Collective Bargaining Agreement (CBA)

For example, if an NFL player has an NFLPA-certified agent, (which Parson’s agent David Mulugheta certainly is) then all negotiations must go through that agent. Period. Teams are forbidden from contacting or negotiating with players who are represented by an agent without the agent's presence.

Jerry knows this! Clubs can face penalties for violating this rule, including the cancellation of any contract offer or signed contract made outside of these rules. This rule protects players by ensuring they are represented by their agent during negotiations, helping to prevent situations where a team might pressure a player into a less favorable deal without their agent present. (Imagine that)

So if we hear Jerry or Stephen say that “we had an agreement last March”, it is a completely invalid argument. Apparently meant to win in the court of public opinion in hopes that many Cowboys fans should buy that. Don’t buy it. It’s invalid.
This is not true. The CBA does not prohibit discussions between the club and player.

But of course Jerry and Micah can talk about the parameters of the deal and agree on the big points of money, years, guaranteed dollars, etc. It still has to go through the agent, yes. But Jerry is right that the deal is between the owner and the player, not the owner and the agent. And that the agent works for the player, not vice-versa.
Right, there are probably some fine language in the CBA that allows such things.
Would be nice to see the real CBA rules.
Other teams have done this as well as Jerry. But yet media and some fans want to make it all out to be Jerry.

One other thought. If the team decides tagging Parsons gives them leverage, it’s fools gold.

Elite NFL players getting tagged damages the relationship between the player and the team because it makes the player feel like they are just a product. Everyone thinks NFL players are greedy and only about the money. But it’s also about feeling respected and appreciated for their talents.

Tagging Parsons will be a huge mistake. If they won’t pay him market value, trade him. I think JJ knows he’s botched this and is clumsily trying to save face. It’s isn’t working.
I've said before if Micah is tagged he will sit out until week 10 and the n show up which will destroy the Cowboys season. It's just moronic for many reasons to even consider this and the whole "he has a contract" crowd are just sticking their head in the sand confusing legality with reality as if they don't follow the NFL.

You are incorrect sir. The CBA clearly states the player’s certified agent must be involved in negotiations.

See above.
This is not true. The CBA does not prohibit discussions between the club and player.
It does not prohibit “discussions” but those discussions cannot be binding, and have zero credibility in an official negotiation.

For example, if I’m an owner I can say to a player, “Hey Joe, what’s it gonna take to get this deal done?” That is allowed. But the results of that conversation cannot be considered an “official negotiation”. Period.

So JJ saying “they had a handshake deal” is irrelevant and non-binding according to the NFL CBA. Jerry knows this. Teams can be fined for trying to circumvent the agent.

That is simply being a fan of the team's projection on talent potentials. Both of us will be watching tonight.

I'm watching for Houston, Collins, and Clark today.

I find great humor in these pointless arguments. I mean, Fans and posters taking sides in this as if their opinion has any effect at all on the outcome. Resorting to anger, name-calling and blocking posters over something fans can't influence is silly.

I think we should all step back and let the chips fall where they will. This "soap opera" will soon be over.

What reasonable take is this?

Please ban him moderators.
I want the ability to sling poop over the internet.

The NFL and the Clubs recognize that, pursuant to federal labor law, the NFLPA will regulate the conduct of agents who represent players in individual contract negotiations with Clubs. On or after the date on which the NFLPA notifies the NFL that an agent regulation system is in effect and provides the NFL with a list of the NFLPA-certified agents, Clubs are prohibited from engaging in individual contract negotiations with any agent who is not listed by the NFLPA as being duly certified by the NFLPA in accordance with its role as exclusive bargaining agent for NFL players. The NFLPA shall provide and publish a list of agents who are currently certified in accordance with its agent regulation system, and shall notify the NFL and the Clubs of any deletions or additions to the list pursuant to its procedures...

There is more to it than the I pasted. The link lists enforcement and penalties. In order to represent yourself you have to file to do so. Micah has not so therefore he is not listed as a certified agent by the NFLPA.
Key words.
Contract Negotiations.
This can mean a finalized contract.
As posted, basic parameters can be discussed.
It has not been an issue for other teams, but now it is an issue with Jerry?

That doesnt mean what you think that means. That just means that the agent has to be certified by the NFLPA. It is designed to prevent a player’s father, uncle or brother from acting as their agent whenever they are not certified by the NFLPA.

That does NOT define involvement. You are wrong. If the owner talks to the player, the agent does not have to be there at the moment...only involved if intended acceptance becomes involve.

You can not redefine contract base elements. You are going to a point of consideration to accept projected elements. He is fully involved in NEGOTIATIONS before acceptance and proceeding from there. Contract is not defeated how you suggested.

I attended Northwestern Law School and contracts was a required class. Again, UCC. If the player wants his agent there just for talking, that is a different element in contract formulations.

The GM can talk with his player and not sign a thing ... so might Stephen.

Nothing is official until there is an actual document.

If Jerry sends a contract to Micah and all parties sign it, without the agent involved...then Jerry would be violating rules.

As of now, it's all just BS posturing.

Forget what Jerry says. There was no gentlemen's agreement. If you agree to lend me $50 and I agree to pay you back, that is a gentleman's agreement. Handshakes and eye contact isnt a deal when we are talking about multi-million dollar negotiations like Jerry says. He tells the story about he bought the Cowboys with a handshake. If someone else can along and offered Bum Bright more money after that handshake, we all know what would happen. That is not a deal. It only is official once they sign the contract. Period.

I don't see how a deal can benefit a player, more than the agent. As far as I know, the agents get their percentage, no matter the dollar amount signed if the contract. Higher contract, same percentage but obviously more money. I don't know if that's the case but to be honest, i don't care about that all. If you mean the agent wants a higher deal so he gets more money, that's a narrative pushed by you know who. Doesn't matter to me really. The agent does more good work for players than people really think. Well the good agents do anyway. Jerry's net work is 16.1 Billion dollars. He is upset over what, 5 or 6 million a year.

The negations stalled because Jerry is trying to to pull a fast one over Micah and the fans. He tried to get something done bypassing the agent. It didn't work. Move on and do it properly now. He could have called the agent and done it. No. He tries to pull this stupid narrative. "I don't talk to agents! Only to the principles!" Then a documentary comes out (this is what I have heard since I refuse to watch) where he is saying he sat down with Eugene Parker (he knew his name) to get Deion's deal done. I just want all of the Jerry BS to stop and really wish fans could see this.
