Surprising good balance on one leg though.

On "refusing" the test, they made it seem entirely optional, and listening to lawyers on what not to do is usually wise, but I think he got it backwards. It's the Field Sobriety tests you don't want to do.

Edit: I guess they did read him the process, but it sounded like he may have thought he had the option to arrange testing for himself. On second listen, it sounds like that's only an option if you submit to their testing.

Yes, Tony's STM (Short Term Memory) is impaired. By alcohol, or pain drugs, or CTE, I do not know.

Tony cannot follow the simple instruction to not move his head. She must have repeated that request 4 or 5 times. Tony's short term memory is impaired, whether from, alcohol, or pain meds, or CTE, I do not know. Also, Tony could not wait for the officer to give the instructions before beginning. He thought he would get to practice the leg stand before doing the leg stand. He thought he could interrupt the officer many times, instead of just listening and then doing. Also, the officer did not ask Tony that once he began the leg stand, to tell her whatever thoughts were coming into his head, and to tell her about his daily workout habits, she was not asking for a conversation.

Yeah, I didn't think he looked that bad either. Could have been buzzed but if I didn't know him or that alcohol might have been part of the equation, I'd have just thought he was a slower talking guy. But we know he does talk faster than he did there. At least on air. I do wonder about the calling your lawyer thing and whether he was in his legal right to want to do that at that point.

I would hope if they're arresting you and putting you in handcuffs that you have the right to call your lawyer.

The fact they didn't let him call his lawyer and he asked them eight times he said could get the whole thing thrown out.

Also if you're arrested I would think they need to read you your rights and I didn't hear that done either.

It had to just be the smell because he didn't look that bad off. He was talking slower than we know him to when he's on a broadcast but beyond that, smell is all there is. Thing is, I never heard the cop mention that she smelled alcohol on him even though it's in the report (and cops never lie about things in their reports, right? Lol). In fact, it seemed more like she was just connecting his playing golf to "oh then you must have had drinks if you were golfing because that's what golfers do." It made Romo do a double take too. I would definitely seize on that if I was his lawyer.

For sure it seemed like as soon as he said he was at the golf course she profiled him as drinking .

Fortunately I don't drink but after watching that whole thing the best thing for him to have done in my opinion.

Would be stop as soon as she profiled him as having had drinks because he was at the golf course he should have stopped right there not done any sobriety tests nothing got arrested be taken in call his lawyer and don't say a word let the lawyer take it from there

All the sobriety tests do from what I can see is compile evidence against you.

He should have let them read him his rights and got his lawyer and not said a word.

It looks like they just keep putting you through calisthenics until you fail.
Also did they have the right to go through his bag use the excuse they were looking for weapons I believe.
Started out as a pure traffic stop because he passed on the right how did it turn into looking for weapons.
Have to say I think Tony got railroaded on this.

It was kind of funny when Tony played the game he did what he wanted on the field changed the plays to what he wanted them to be.

He went through the field sobriety test pretty much the same way did his stretching exercises moved his head following the pen

Took his shoes off he also didn't bother counting his steps or counting when he was standing on one leg.
Can't change the spots on a leopard he did the sobriety test the way he wanted to do it

We weren't there and don't know if there was really a strong odor of alcohol or not he was out in the sun all day golfing could have been a little sunburnt and his eyes may have looked red.

When they make the decision to pull you over and invest the time. They are getting paid to compile evidence and make something happen.
They don't move up the ladder without compiling arrests and citations.

Drinking before driving was bad enough but for Tony not to be extra careful so he didn't get pulled over was really a mistake.

He wasn't following the directions he was being given during the sobriety test but he also didn't show that he was impaired either.

But since when did Tony ever follow directions he always change things up and did them the way he wanted to do

What would you expect an officer to do?????

Follow him to Grandma’s house.

He wasn’t trashed. He answered her questions and was respectful. He wasn’t falling all over. Completely sober I would have trouble doing the tests. He has a screwed up back. I wouldn’t expect him to be able to do it perfectly.
