At the start, neither one of them could hear each other clearly due to the noise on the roadway. He was polite, answered all her questions, cooperated with field tests. Lawyers always tell you not to do the breathalyzer because it is a faulty test. I am willing to bet that the case gets dismissed. Nothing in the video suggests he was impaired. And one beer will you put alcohol on your breath....doesn't make you impaired.

Did he look wasted? No. Were there things that suggested impairment? Absolutely.

The balance on one leg was pretty impressive though.

That's a good point since the loudspeaker was the first topic of discussion between them. If she thought he "might" try to avoid her then that ratchets things up to start.

I believe that there's another part of the video, where she calls in to inform her dispatch that (at that point) he's not following instruction to get out of the car.

When a Police Officer says "I need you to step out of the car" that doesn't really mean "I need you to step out of the car when you get through texting someone..."

Bty, during the process of being detained (step out of the car), you Do Not at that time, have any Constitutional right to call your lawyer, or your Mother, or whomever...

The fact they didn't let him call his lawyer and he asked them eight times he said could get the whole thing thrown out.

17 million a year is a lot of money to pay somebody and if you don't really like the way he's coming off but don't have a good excuse to fire him you may need to find one.

They already had a sit-down with him.
So how hard would it be to pay somebody next to nothing in comparison to watch him at some of these events see if he's drinking and tip off the cops problem solved legitimate reason to fire him and move on to who you really want in the job that maybe we'll do it for half the money

People are focusing too hard on the "Drunk Driving" issue. The Police Officer smelled alcohol, and that was combined with erratic driving.

If someone (who had had nothing to drink) was just extremely tired while driving, and was crossing the line back and forth, for example, that driver could be pulled over and issued a citation for that line crossing, AND for driving impaired.

Imo, Tony Romo was driving impaired. And Tony could only follow part of the instructions he was given. And the cause of Tony's impairment, whether from alcohol, pain meds, or CTE, I can not say.

The legal system, over time, has eroded many the rights you mention, all of which ultimately came out of the fourth amendment

Where they address this with DUIs is through the traffic laws. Simply driving carries “implied consent”.

• When you drive your vehicle today, as soon as you get on the road, you are consenting to chemical testing
• Right to an attorney only protects you from being interrogated without counsel
• Chemical testing is evidence collection, not interrogation so they can and will not allow you access to an attorney unit it’s complete
• Insisting on an attorney before testing is considered a refusal and will result in a suspension of your license

As to Miranda, well, this is where the police have got a bit of legal trickery to help them

Miranda only applies to being “interrogated”

Miranda only impacts verbal interaction and “evidence collection” bypasses Miranda

These are all things that can happen to you without the police ever reading you a Miranda warning

• Pulled over and questioned “oh, at the golf course!” Duh duh duh
• put through field sobriety testing
• given a roadside breathalyzer
• Have your vehicle searched and impounded prior to a tow
• Be put in a squad car and transported to jail
• Be subject to a strip search
• Be subject to a body cavity search
• Put through chemical testing
• Charged and booked
• Held for days in the jail

What they can’t do is prevent you from contacting the outside world, (only the Feds can do that), including an attorney.

All of this is why citizens should be polite and not resist, but also understand that every question, action, movement, are intended to generate, secure and record evidence to be used against you.

Obvious sign of impairment right there. Not being able to follow the simplest of instructions.

He literally botched all 3 tests horribly. He didn't walk heel-to-toe. He didn't count his steps out loud. He didn't count while doing the 1-leg stand.

He should've refused to take the tests, but he didn't and failed them miserably.

Also, he didn't even disagree or argue when the female cop said she smelled booze on him. He wasn't hammered but he knocked back a few. Doesn't take much to be impaired and over .08.

You have to get out of the car when asked to do so.

Refusal is an arrestable offense, even if you say, "Hold on, I'm calling my lawyer first." Nope, doesn't work that way.

You have to ID yourself and comply when asked to get out of the car.

Beyond that, you shouldn't answer questions and you certainly shouldn't take any of their tests.

Tony botched the tests horribly and gave them tons of "probable cause" for an arrest. I've seen a million of those police bodycam videos (guilty pleasure on YouTube!) and I've seen FAR more "sober-looking" people get arrested. Tony was clearly impaired and he knew it by the end - hence the refusal to submit to a breathalyzer.
