I get this but you guys do know the reason he didn’t take it wasn’t because of the fear of a false positive but it was because he had been drinking?
I mean sure smoke probably means fire, but protocol is protocol because human error is a factor. You got cash? no tests. You take uber 3 months and let your lawyer handle law stuff is all I was suggesting.

You got cash, you lawyer up and take uber for 90 days. That's what you do when human error is a factor. So, lol 100% right not to have to prove innocence on the spot. Are you from the USA? You are not required to even speak much less lick boots and take a test you could fail sober. There's videos on YouTube proving my point.

I suspect one of the worst parts of this for him is having to face his wife and kids.

Regardless of the seriousness or lack of, no family wants to see their dad and husband on the news like that.
It's not really THAT bad....if all other things are good. If they are a tight family....this is really nothing on the scale of things that DO happen in life.

If he's driving when he can't pass a field sobriety test, then he has a problem even if it was a stupid mistake. An average of more than 11,500 people are killed each year in the United States because of drunk driving. Thankfully, I've never lost someone I love to that but I do know others who have. And it's sad that something so preventable causes such tragedy.

I'm going to go out on a pretty thick limb and say he was intoxicated. However, you are 100% correct about the FST. It's designed for you to fail. My buddy is a NYS Trooper and he's given me this test stone sober and I failed badly. Never submit to one if you have nothing to hide and demand breathalyzer and/or blood test to prove sobriety.
