No, we just don't instantly think someone is innocent or guilty based on accusations and BS tests. In what world do you think he can pass that test? I took one at 24 and passed, and even I had to apologize to the officer because he thought I was being rude when taking the pen test by stating "I have peripheral vision". You know when you take those they are looking for any clue to suggest you are drunk whether you are or not, and it is entirely speculative if their judgement has any weight.They refuse to factor the case in it's entirety.
Instead they cling to the "bad cop" narrative. Or, pick pick ONE and ignore all the rest.
- Unsafe pass - Literally the reason he was pulled over
- Wreaked of alcohol
- Failed numerous sobriety tests
- Open bottle in the vehicle
- Refusal of breathalyzer

His rights were read to him by the female cop. She had to use a cheat sheet but she didNone of the video I watched shows Tony having his rights read to him.
I would think and the lawyer in the other video agrees that when they put the handcuffs on him he should have been mirandaized.
That said it could have happened on the ride to the garage where they did the field sobriety test.
I would think if they did not read him his rights on the way over to the garage everything obtained in there would be inadmissible evidence.
