• Wreaked of alcohol
• Failed numerous sobriety tests
• Open bottle in the vehicle

No, we just don't instantly think someone is innocent or guilty based on accusations and BS tests. In what world do you think he can pass that test? I took one at 24 and passed, and even I had to apologize to the officer because he thought I was being rude when taking the pen test by stating "I have peripheral vision". You know when you take those they are looking for any clue to suggest you are drunk whether you are or not, and it is entirely speculative if their judgement has any weight.

I'm not here to say he's innocent. I'll wait for the toxicology to make assumptions because INNOCENT until PROVEN guilty is the name of the game.

I would think and the lawyer in the other video agrees that when they put the handcuffs on him he should have been mirandaized.


That said it could have happened on the ride to the garage where they did the field sobriety test.

I would think if they did not read him his rights on the way over to the garage everything obtained in there would be inadmissible evidence.

His rights were read to him by the female cop. She had to use a cheat sheet but she did

Tony was detained but not arrested when the cop drove him to a safer place to do the Field Sobriety Test. He was handcuffed for his and the cop's protection.
At that point Tony is under suspicion of being under the influence of alcohol.

So let's put your Miranda briefcase down for a moment. After Tony failed the test, and was under arrest, the cop actually did read him his rights, but, not before. Tony kept asking for his lawyer, but while being detained and field tested, before Tony was arrested, Tony actually had NO right to have a lawyer present, no matter if he asked 100 times. All of the blabbering that Tony did before he was put under arrest can be used in a court of law.
