For the record, I was rear ended last year. I did not get injured, so just asked they pay for damage and give me a rental. However, if I would have had some pain and any inkling that it could be a long term issue, you better believe I'm protecting my family's financial situation before I'm looking out for Gieco.

Come to think of it, since the auto insurance would be paying for any medicals rather than my heath insurance, you should be ecstatic at least one of these conglomerates is saving some cash for their bottom line.

Then you brought the morality argument into this. I'm just advocating for the individual, while ya'll are looking out for big business. Someone should feel bad for using the system the way it's set up.

So just to make sure; if he's not injured he shouldn't seek any money other than that to repair his vehicle?

But if he is injured, I believe he should peruse the largest settlement--which is probably where we disagree.

If he's injured he should seek the most he can get. My only beef is those who aren't injured but claim they are seeking restitution.
 
Car should be fixed, medical bills should be paid, you should go see a chiropractor and do some treatments and get a check for the inconvenience. Get a lawyer and be truthful with your treatment and it will be all good.
 
Got rear ended. The guy had State Farm and filed a claim. Not a ton of damage, but my wife and I have pretty bad neck, shoulder and back pain. We went to the local First Choice ER and got X-rays. Everything looks good, but we're both extremely sore this morning. I'm going to call the claims adjuster today. Anyone have any insight? Not my first auto accident, but it's the first time I've been injured.
