And there are also people who take the opposite side and without question see some poor woman who was raped. It also does not help there is a race element involved as well.

But given the social circumstances that exist now, it is going to happen.

Of course. My point is that both are equally bad and we shouldn't be resorting to either of them. Or taking up for either of those positions, for that matter.

Sexual assault is a devastating crime that attacks the body but just as importantly attacks the mind. I'm not for anything that makes it harder for women (or men) to come forward. Even if that means a few more false positives.

Imagine being a woman who maybe puts herself in a compromising position. She has limited evidence to use on her attacker. And now it's a felony if you can't prove an accusation. Why would you come forward?
Falsely accusing someone is a devastating crime as well, which, to me, is equivalent to rape. Imagine you're a man who's falsely accused. Your reputation is shot even if you're not found guilty or even charged. If you are found guilty, you're going to prison and your life is virtually destroyed.

Not being able to prove sexual assault is one thing. Someone totally fabricating it - for example, the Duke Lacrosse strippers - is another thing entirely.

I don't think anyone condones not punishing people who slander and commit libel.

That isn't even part of the discussion.

What is very dangerous is heading down a road that would make women hesitate to come forward when they are victims of sexual assault. A lot of rhetoric in this thread is in that vein.
