Any good reason why Aldon Smith won't be suspended for our first game?

I don't expect him to be suspended by the league. He has made it this far without the league doing anything to him. Why would they change their stance now? They have actually been pretty lenient in handing out any suspensions other than for failed drug tests in recent seasons. Kenny Britt, Marshawn Lynch and many others have had off the field issues the last few seasons and haven't been suspended. I'm not looking at it from a should/shouldn't perspective. I'm just guessing based on what the league has done over the last few years, which is mostly nothing.

With as much publicity as his arrest received, the league has to suspend him.

Knowing our luck, I bet he plays and has a career day while also injuring Romo ... Man would I be one livid son of a gun.

If your looking for guys not playing in that game, Navarro Bowman will most certainly be on the PUP list and may not play at all in 2014.

I did a little looking around because somehow I missed all of the news about Aldon Smith's problem. The (2) DUI charges are misdemeanors; one of them includes marijuana. The (3) "assault weapon" felony charges came from rifles he legally purchased in Arizona and weren't modified to whatever is legal in California when he moved there. The prosecutor has to prove Smith intended to break the law by bringing the rifles into California in order to get a conviction. With regard to the bomb threat, the USA Today had a headline last month that stated, "Aldon Smith escapes felony charge for LAX incident". He had been randomly selected for secondary screening when he said something about having a bomb, according to the TSA screener.

He was pretty fortunate not to have been charged with felonies for firing (3) warning shots. Aldon and other witnesses must have convinced the cops they were fired in self-defense.

I think he has a decent shot at walking away from this without getting rung up for a felony, but he still has plenty of trouble ahead. Definitely WKG, but a real sack machine - 42 sacks in 43 games.

Harblow will use his special skills as an orator to plead for him not to be punished and if that dont work he'll remind everyone that the Seahawks are using PED's then make a face and walk away.

basically the weapon charges would not happen virtually any other place in the country except California. Now that stupid comment at the airport- that was truly dumb but still somewhat understandable. Actually the DUI would have been the worst but now with so much now about legalizing MJ maybe not.

But this I knows: Had Roger Goodall's flight been delayed by this miscreant at LAX, he'd be suspended as of that day.

Discipline:

Upon learning of conduct that may give rise to discipline, the League may initiate an investigation to include interviews and information gathering from medical, law enforcement, and other relevant professionals. On matters involving NFL players, the League will timely advise the NFLPA of the investigation and outcome. As appropriate, the employee will also have the opportunity, represented by counsel and/or a union official, to address the conduct at issue. Upon conclusion of the investigation, the Commissioner will have full authority to impose discipline as warranted.

Discipline may take the form of fines, suspension, or banishment from the League and may include a probationary period and conditions that must be satisfied prior to or following reinstatement. The specifics of the disciplinary response will be based on the nature of the incident, the actual or threatened risk to the participant and others, any prior or additional misconduct (whether or not criminal charges were filed), and other relevant factors.

Unless the available facts clearly indicate egregious circumstances, significant bodily harm or risk to third parties, or an immediate and substantial risk to the integrity and reputation of the NFL, a first offense generally will not result in discipline until there has been a disposition of the proceeding (or until the investigation is complete in the case of noncriminal misconduct).

With respect to repeat offenders, the Commissioner may impose discipline on an enhanced and/or expedited basis. In such cases, the timing and nature of the discipline will be determined by the Commissioner based on several factors including but not limited to: the severity of the initial charge and later charge; the facts underlying the later charge; the length of time between the initial offense and later charge; and the player or employee’s compliance with counseling and other programs. Following a full investigation and/or resolution of the proceedings, the Commissioner will review the matter and make any appropriate adjustments.

I wonder if the league is a little reluctant to suspend players during the offseason there is a far less structured environment. Not food for the player, team, or the league if they suspend a guy for something like a DUI and he goes out on a bender and gets another one.

I don't know what problems he has gotten himself into since the 49ers told him he wasn't going to play and that he needed to go to rehab but I would imagine a suspension will come if his problem are significant.
