Any good reason why Aldon Smith won't be suspended for our first game?

If he plays then it's because we're the Cowboys. I keed. Don't know. My guess is he gets suspended but when and how long and does it get appealed.....

Its that double edged sword- If he were a Cowboy and played it would be because he was a Cowboy and Jerry pulled strings( I just read this in a yahoo comment about Henry Melton) but if he doesn't it's because he's a Cowboy and we are being punished LOL The sensible thing to do would be for him to miss time early in the year but the most serious charge was reduced(I think) because no one really thinks he was threatening to blow up an airport and the guns were legal in Arizona when he bought them. The NFL could view this as just a guy with a DWI and an attitude problem and since the 49ers are one of the media darlings right now he might not miss any games if he makes it through TC without any incidents. Who knows? Plaxico Burress went to prison for shooting himself.

I don't expect him to be suspended by the league. He has made it this far without the league doing anything to him. Why would they change their stance now? They have actually been pretty lenient in handing out any suspensions other than for failed drug tests in recent seasons. Kenny Britt, Marshawn Lynch and many others have had off the field issues the last few seasons and haven't been suspended. I'm not looking at it from a should/shouldn't perspective. I'm just guessing based on what the league has done over the last few years, which is mostly nothing.

I would not bank on that he has plead no contest and could be looking at some jail time.

He plead no contest today and John Clayton thinks a 3-6 game suspension will be announced before TC. I hope the appeals process is resolved before our game.

3-6 games for a long slate of malfeasances including two DWIs, possession of Drugs, potential Felony Gun charges and a bogus bomb threat...... yet WR Josh Gordon is suspended for an entire Year for his 2nd bad U.A.?



What's this, a double standard?

I see no possible way he plays in the opener. I think it's more likely he's out for the entire season than no suspension at all.

My gut is six games. And with a plea of no contest for multiple offenses, he could be looking at jail time anyway.

He will get suspended, and then Harbaugh will give Goodell one of these:

Sounds to me like he deserves at least a 3-game suspension. Whether or not it happens in time to keep him out for game one is anybody's guess. Personally, I'd like nothing better than to see him missing against us. We'll need all the help we can get to win.

I agree, 3 games sounds good. That way he can come back for the Eagles game. :D

San Francisco 49ers outside linebacker Aldon Smith has pleaded no contest to three felony weapons charges and one misdemeanor driving under the influence charge.

Cam Inman of the San Jose Mercury News reportsthat Smith entered the plea this afternoon and will be sentenced on July 25. Smith said, “Yes, your honor,” about 15 times in response to a series of quetions about wiving his rights to a hearing.

The weapons charges stem from a 2012 incident in which Smith was stabbed at a house party he was throwing. Police who were called to the scene discovered three illegal assault rifles at Smith’s home. Smith could get any sentence from probation to four years and four months in prison on each of the weapons charges.

The DUI charge stems from an arrest during the 2013 season. That was Smith’s second DUI arrest. Prosecutors have said they could seek up to six months in jail on the DUI charge.

In addition to potential prison time, Smith will likely be suspended by the NFL.

Despite what he deserves, I would rather see the Cowboys play them at full strength. Otherwise, the trolls have an excuse. Not a very good one, but you know they would use it.

Meh, regardless homers will find an excuse. Hell the Kaep sexual assault will be enough of a medi event they can use that if Kaep is below average. Gore gets hang nail. Stevie does not have grasp of the playbook, Bowman being out. They already have them lined up.

Beyond the troll issue, I really want to see what the Cowboys have and the only way you truly find that out is playing teams at their best.

Does this mean Smith would serve anywhere from zero jail time to 13 1/2 years? Hope he has a good lawyer.

Now, the league's Personal Conduct policy officially kicks in. If you are a Goodell critic and he doesn't act on Smith very soon, you can really let him have it now.

I wonder if the league is a little reluctant to suspend players during the offseason there is a far less structured environment. Not food for the player, team, or the league if they suspend a guy for something like a DUI and he goes out on a bender and gets another one.

I don't know what problems he has gotten himself into since the 49ers told him he wasn't going to play and that he needed to go to rehab but I would imagine a suspension will come if his problem are significant.

You're still a representative of the league. You don't want to be known as a company who has employees running around the country making bomb threats at airports. But if Aldon's lawyer can present some evidence that Aldon has psychological problems, I think the league would be reluctant to suspend him. It might look worse if they punish someone with "mental problems."

I was just pointing out that suspending now versus later doesn't matter in terms of dishing out the punishment.

It may matter though in terms of how a player responds when comparing a more structured environment to a lesser one.

The odds are favorable that the league would enforce the Personal Conduct Policy and suspend Smith. The 49ers and the league would follow-up by providing Smith with professional psychological assistance. The Shield would be protected. Any negativity would be minimized since Smith's employer and organization would be seen helping him obtain the medical assistance necessary to recover and return to work. It's a win-win.
