Report: Prosecutors poised to charge Stallworth with DUI

Mike Florio of Profootballtalk reports that as authorities in South Florida wait for the results of a blood draw performed on Browns receiver Donte’ Stallworth, a source with knowledge of the investigation tells us that prosecutors are preparing an indictment for DUI manslaughter, under the assumption that the results will show that Stallworth’s blood alcohol content exceeded the legal limit of 0.08 percent when he collided with a pedestrian, who later died.

Per the source, Stallworth admitted to drinking at least four Patrons and two Margaritas. A separate source called that information “basically right,” but added that Stallworth contends he had his last drink at midnight. The incident occurred after 7:00 a.m. local time.

when they draw blood from you, it's pretty obvious that you're under the influence

they don't ask everybody involved in an accident to do that

sadly he'll only see a year in prison, if that

Sadly? why would you want the man to get jammed up?

what if it wasn't completely his fault?

Who uses the word "haters" all the time? You or me?

See, the thing that people don't understand is that if you "hate" someone, that means that you have feelings for a person or thing that you hate.

What is the oppsite of love? It's hate...

So, knowing that, if you love or hate someone/something, that means that you have feelings for whatever reason.

The opposite of love or hate is indifference. That is why I feel like when you or others call people "haters" (like the TO gig)...it just makes you look stupid.

I never knew TO, so I could not love him or hate him, yet I was indifferent to him. Yet, you called me out as a hater...

Stick around, maybe you can learn something...you and others.

And as far as your pogo stick...put it where the sun don't shine....

You're a piece of work. I've been well over the TO thing for a bit now. Some of you just can't let go but I am confident you'll eventually get over it. Best of luck to you.

That's not true at all.

Somebody gets killed, they're drawing blood regardless.

I think it's safe to say they must have smelled booze if they asked and he admitted drinking.

I know I don't drink myself, never have, never will, but a lot of you do it and you go out to the club/bars/etc.... You simply have not been caught or have not had something horrible happen to you yet, but it's a matter of time if you're being careless by drinking and driving. Anything can happen, not saying that this was the case.

yea i like the way, you changed my sig, but didn't change the little "were doomed" crap by my name....whats the matter? you can dish it, but cant take it?

anyways...thats the problem with most of us Americans, its a sad country, just can't wait to see someone get jammed up....you all love the drama and are so quick to see a man get prosecuted ....a-rod...bonds....ect...thats all that makes the headlines, just love to see a person get jammed up

What if he wasn't drunk? and it was just a complete Accident on both sides? does he really deserve to get his freedom taken away, especially if he didn't mean it, or isn't a real evil person?

if someone hit and killed, a family member of mine, by complete accident, and they weren't drinking, or being dumb....yea id still be pissed, and be thinking crazy thoughts, but in a clear mind state, at the end of the day, its life, sad, but its true

but if he was drunk, then give him whatever, because that would basically be his fault

If the report that he was drinking maragritas is legit, I am pretty sure his blood alcohol was over .08, even if the accident happend many hours later.

Alcohol breaks down slowly in the body and even if you do not "feel any affects", you blood alcohol can still be over the legal limit.

Now I am not saying he is guilty, we have to wait for the lab results, but if he admitted to drinking some margaritas and the prosecuters are already working on charges to file...................I think it is safe to say that he was probably over the legal limit.

AND THIS HAS NOTHING TO DO WITH RACE, HE KILLED SOMEBODY!!!!

Even if it was the pedestrian's fault (yes, pedestrians cause accidents), if he was over the limit and they can prove it, he's going upstate for a stretch. However, good defense attorneys can tear holes in even the most supposedly bullet proof blood tests.
