We can both agree that drinking and driving is a bad idea.
I also suspect that with anyone that even occassionally drinks outside of their home, there is a 99% chance that they have driven home at some point in their lives.

It's a bad idea no matter what, but it's the ones that do it often that seem to always get into wrecks. They often are even driving with suspended licenses; it's so common for them.

I’m not condoning drinking and driving and I’m sure this has been said in this thread but never do those field sobriety tests if asked. They can't make you. At the point they ask you to do it, you’re probably going to jail whether you’ve been drinking or not. Especially if you’re an old fart like most of us on here.

It hasn't been reported as far as I can see. They would have to have gotten a search warrant to draw blood. I "think" they usually do. Unclear if they did.

I don't do it anymore, but back in the 80s and 90s, it was commonplace to drive home buzzed. Pretty much everyone did it. The idea was to not drive drunk to the point where you were seriously impaired, and couldn't walk a straight line.

Yes you forgetting Tiger Woods Same thing He actually passed the breathalyzer but they think they need the blood test I don't know if he even gave one Some places they force you to do it with a warrant because some places have times around the holidays where they call it no refusal so they force you to do it but they have to get a warrant and they have to have good probable cause to do so..

We don't even know if he was over to legal limit I looked at the video the guy could have had.05 instead of .08 we don't know trust me the field sobriety tests are garbage they're just done for the camera so they can show probable cause in their minds because they're trained to look for a jittery eye or a weird walk I've been in this position before and they were wrong I was falsely arrested It took them three months to get the blood test back they would not give me a breathalyzer they refused me my right to not be arrested because they wanted the blood test..

So let me give you some info not everybody is drunk driving even if he was 0.04 which is half the legal limit he has a right to drive maybe he drives well that way you cannot judge people I do it but I'm very aware that when I'm drinking I want to make sure that I feel right and that I you have a little breathalyzer It's a very accurate one there are only like 100 bucks at least I'll know for sure where I'm at I know this they start looking at point 05 as impairment and they can charge you with other things if they feel like you hit something or there was an accident even if you're not .0 8 they could start trying to find another way to get you..

Yes be smart but everyone has had drinks and drove home that doesn't mean you're drunk driving that does not mean you're over the limit and just because a cop thought they seen you swerve you know how many people I see swerve everyday cut me off not use their turn signals speeding and they're all sober they're just distracted Lots of people can be distracted you can look over at your phone and go into the other lane it happens all the time so when they pull you over for this probable cause they may even smell a beer on you that does not mean you're legally drunk or impaired enough to be dangerous for the roads that is subjective and each individual is different....


Guess what they don't apologize they don't refund your money this is all works two ways they say they're saving lives including your own and making the streets safer no they're collecting money because if they're wrong they don't care they don't have to refund your money or apologize and now they embarrass people like Tiger and Romo because they are somewhat famous They're plastered all over There were twice as many Tony Romo reports on Facebook some of them false reports made up stuff then there were Tiger and that is crazy Although I do live in DFW maybe that's why..

But I'm telling you this kind of thing gets them a lot of money and they need to change the law if they're wrong they need to refund every bit of your money and some money for your lost time and embarrassment they need to stop guessing, Should always have a field sobriety breathalyzer even if it's not the one the will accept just to check Before they even bother with a field sobriety test or taking you into custody which is not always an arrest because they can do the breathalyzer at some of the places they take you in the jails they have to get a warrant you have to sign the release or you just sign the release without a warrant and then you can do the breathalyzer and most of the time you're gonna walk out of there.

I'd be interested if they ever got any lab tests or measurement of his actual blood alcohol content. People can speculate on if he was drunk or not and we all agree that if he was it's not good at all.

However, until we know for sure, it's all just guesses. I guess you can say he was loopy or whatever. To me, he looks fine.

The one thing that's obvious is this police officer made several mistakes. The most noticable to me was not reading him his Miranda rights after she detained him. You don't have to be formally arrested, only if the subject thinks he or she is not free to leave. Once she detained him on the side of the road in handcuffs she should have read him those rights. I'd argue that everything after that point could be inadmissable.

Cop then then said he had "probable cause" to search my car. I was naive at the time and thought that was true and didn't protest. He found my handgun. My CCL had just expired (this was in Texas). Texas at the time allowed you to travel between counties with a firearm, which of course the teenage looking cop didn't know. I spent two days in jail in someplace called Cleburne, Texas. Charges were dropped after I explained the law to my own lawyer. Cost me about 2K and the value of the gun (about $900). I could have retrieved the gun but did not want to drive back to that hellhole. Not even sure of my point other than most cops want to find a way to arrest you in my opinion.

As soon as I did it everything started spinning. I thought I was going to feel my head hit the grass at any second. Then he said, ok, and I was still upright. A miracle. And I didn't drink that much. But I can see if you're drunk, you'd probably fail that quickly.

I have a big problem with those field sobriety tests. When I was young, I could probably do them drunk and with an added backflip. As an older sober man...probably not. I wake up and everything hurts. I can't even imagine doing the one legged stand. I don't mean to make light, but everyone needs to see this. I laugh inappropriately every time.

It's like I mentioned in the past, it's just one piece of evidence. You don't have to do it. But if you refuse, they'll probably ask you to take a breathalyzer. Refusing that will have consequences. They might ask anyway, but if you do well with the field test, they might not if they don't have it with them.

Good point, they don't all have the analyzer. Hopefully I am never in that position again, but I would refuse everything based on what I know now. Generally, refusal of the breathalyzer is an automatic suspension of your license. I would take that instead of relying on an unreliable test. I'm not sure if anyone has mentioned it but even the blood tests are unreliable. My point is, don't convict yourself, which I think a lot of people do.

When I moved to Texas 40 years ago, you could still legally drink and drive....was sooooooo commonplace for people to be throwing back a tall boy or two on the way home from work. It wasn't until the mid 90's that it became illegal for anyone in the vehicle to have an open container.

My Dad always had an open beer in the car. Not saying it was right, but he always got us home safe. People forget the legal alcohol level used to be almost double what it is now.

The officer read him the implied consent thing which is stating that consent to a certified breathalyzer, (not the roadside preliminary breathalyzer test) or a blood test was implied when he was issued a drivers license and that a warrant from a judge would be requested if he refused to voluntarily provide one.

Not sure which route he chose but I'm sure he was tested.
