While the degree of relevancy is probably in the eyes of the person filing for divorce and the judge, that's really beside the point. And Texas does at least.

I know that up here it has no bearing whatsoever on a division of assets. How many states in the USA are still fault states?

I could see such an argument, Mr Jones did you,,, Well yes I did but only because my wife wouldn't.

Texas is a no fault state... meaning that you can get a divorce without a fault grounds being proven. But the only guidance the law gives a court in dividing assets is that it has to be "just and right," which pretty much means a judge can divide it any way he damn well pleases. And if you prove fault grounds (such as adultery, or disparity of earnings, or waste of money, etc.) all of those can lead to a disproportionate division.

My guess is that if any judge in DFW had a choice to award the Cowboys franchise to Jerry Jones or anyone else he/she would go with the latter.

And don't quote me, but I think most states at least allow you to use it for argument on division of assets.

It's absolutely a losing argument because a marriage decree is a legally binding document and adultery is a punishable crime. "Till death do us part." Not, "till you no longer want it" or "I can no longer get it up."

Not satisfied with your wife's output? Get a divorce before you lube up every hole in the barn, not after you get caught.

Pep, up here, out statute specifically state that assets are divided equally subject to variation on specific grounds that do not include sexual escapades.

Texas doesn't seem all that progressive in terms of family law ;)

Clearly, but that wasn't the question. I don't think anyone will ever accuse Texas/Texans as a whole, of being "progressive."

But I tell you what, you screw around on your wife/kids, you deserve to get throttled by a judge. Just my $.02
