This is getting a bit tricky and tough to explain without having a conversation. I know exactly what you are attempting to say. For you to say that this man is a thief, you would have to know that said man acted against God's law or more importanlty, His Devine Will. For example,

(technically this could be classifed as stealing, unless you are a traveler, in order to relieve your hunger or thurst and until you should arrive at his resting-place where he may buy bread and wine.)

If you WV where an a by-stander, you would call this person a thief if you didn't know he was a traveller. Because you nor I know what was placed on this persons spirit, we can't define him.
But although the liberty of eating to their fill is granted, still it was not allowable to gorge themselves. This, then, is the sum, that it is not accounted a theft, if a traveler, in order to relieve his hunger, should stretch forth his hand to the hanging fruit.
Again, how could you or I detremine if the person ate to gorge themselves. We can't. But God can.
So how can I call anyone a thief, if I don't know the whole truth and only God knows the whole truth.
