This might be a silly question, but how can you testify under oath to a body that doesn't have subpoena power?

How in the hell can they make Elliott testify "under oath"? This isn't a court proceeding. It's not a civil suit or a criminal matter. It's simply an NFL dog and pony show. I see no way they have the authority to put anyone under oath.

I think the mentality would be to treat the incident as "new business" since it wasn't already included but with a similar period of suspension.That would make the NFL look absolutely terrible considering they've already said that incident was not considered in determining the suspension. To reverse course on that issue would make them look vindictive and prove they were wrong to begin with. I don't see it happening.
