Just a note here.....You're missing the point regarding changing conferences. Almost all non BCS teams would love to be in a BCS conference with all of its advantages. You can be sure that TCU would love to be in the Big 12, Boise in the Pac 10, and even and an ECU in the Big East. They all have better attendance and success than several of the BCS schools....even with the current disadvantages. There are huge recruiting advantages and much larger dollar payouts and prestige. Do you think if Baylor ,Iowa St (even Tx Tech) were in the WAC that they'd have the revenues that they have? What about Cincy (or Lousiville) now in the Big East? When they were in CUSA they were not so powerful...it was after they got in that they really flourished. What about Northwestern...what if they were in the MAC? Rutgers in the MAC vs Big East...they would have nothing. Being in a BCS conference provides a barrier to entry.

Those conferences do not have to let anyone in--that's not what I'm saying--but at least settle the national title on the playing field like all other sports do. And all D-1 conference champs should have a fair shot.

You do understand that probably 90% of the universities in the BCS are state universities right?

When's the last time NYU fielded a football team?

Good point.

Way I look at it:

At least the GOV would be doing something that the people are asking for.

As I understand anti-trust law, there is no violation in the BCS system. That said, the government has every right to investigate anti-trust claims.

If the government wants to get involved, they certainly would have the ability and the precedent to do so through the commerce clause.

Not that I believe it's right or wrong, it just is.

Hey Pep, how goes it?

What are you thinking on the Commerce Clause? I always thought that this was rule of law that applied to Foreign Commerce, Indian Commerce or Interstate Commerce. How does it apply here?

Hey ABQ, goin well man...

You're right on how the commerce clause gives the government the right to regulate Interstate Commerce. And there are very few limitations from courts as to what actually constitutes "Interstate Commerce." Congress can pretty much regulate anything that has to do with interstate commerce.

As an example of it being used in IMO an overreaching manner, in the past, courts have upheld government intervention into purely local businesses merely because they have purchased food that traveled across state lines. Go check out a synopsis on Katzenbach v. McClung, Daniel v. Paul, or more recently, Wickard v. Filburn and Gonzales v. Raich.

With those kinds of precedents upholding governmental regulation of things that were MUCH more localized than the NCAA or the BCS, and things that affected MUCH less in the grand scheme of commercial activity, there's no doubt in my mind if the government wants to regulate this, they can.

Sounds like an epic waste in Taxpayer money.

Personally, I just think the Administration should stay out of it if it is not hurting the consumer and it is a "luxury" and not a "want".
