Justice Dept.: Obama administration may take action on BCS


WASHINGTON (AP) -- The Obama administration is considering several steps that would review the legality of the controversial Bowl Championship Series, the Justice Department said in a letter Friday to a senator who had asked for an antitrust review.

In the letter to Sen. Orrin Hatch, obtained by The Associated Press, Assistant Attorney General Ronald Weich wrote that the Justice Department is reviewing Hatch's request and other materials to determine whether to open an investigation into whether the BCS violates antitrust laws.

"Importantly, and in addition, the administration also is exploring other options that might be available to address concerns with the college football postseason," Weich wrote, including asking the Federal Trade Commission to review the legality of the BCS under consumer protection laws.

Several lawmakers and many critics want the BCS to switch to a playoff system, rather than the ratings system it uses to determine the teams that play in the championship game.

"The administration shares your belief that the current lack of a college football national championship playoff with respect to the highest division of college football ... raises important questions affecting millions of fans, colleges and universities, players and other interested parties," Weich wrote.

Weich made note of the fact that President Barack Obama, before he was sworn in, had stated his preference for a playoff system. In 2008, Obama said he was going to "to throw my weight around a little bit" to nudge college football toward a playoff system, a point that Hatch stressed when he urged Obama last fall to ask the department to investigate the BCS.

Weich said that other options include encouraging the NCAA to take control of the college football postseason; asking a governmental or non-governmental commission to review the costs, benefits and feasibility of a playoff system; and legislative efforts aimed at prompting a switch to a playoff system.

Weich noted that several undefeated teams have not had a chance to play for the national championship, including TCU and Boise State this year and Utah last year.

"This seemingly discriminatory action with regard to revenues and access have raised questions regarding whether the BCS potentially runs afoul of the nation's antitrust laws," he wrote.

Hatch, a Utah Republican, was steamed that his home state team was deprived of getting a chance to play for the title last year.

"I'm encouraged by the administration's response," he said in a statement. "I continue to believe there are antitrust issues the administration should explore, but I'm heartened by its willingness to consider alternative approaches to confront the tremendous inequities in the BCS that favor one set of schools over others. The current system runs counter to basic fairness that every family tries to instill in their children from the day they are born."

Under the BCS, the champions of six conference have automatic bids to play in top-tier bowl games, while the other conferences don't. Those six conferences also receive more money than the other conferences, although the BCS announced this week that the ones that don't have automatic bids will receive a record $24 million from this year's bowl games.

Bill Hancock, executive director of the BCS, said that officials there would need more time to review the letter before commenting on it. He did say, "We're confident that the BCS structure complies with the laws of the country."

"The consensus of the schools is to go with the BCS," Hancock added. "We feel strongly the people in higher education are the people best equipped to manage college football."

This is not a government problem. They should be sticking to the other problems that we have going on, not college football..

Haha......this is ridiculous. BCS is a joke. How any sport can go without a clear cut champion is beyond belief.

Its almost like Vince McMahon has a controlling share of what happens.

Yes, BCS is a joke. BUT.......

Why does the govt. have to put their hand in this? Leave it to the schools.

The government puts their hands in everything else. Why not this? College football makes billions of dollars and lines the pockets of these major conferences, the universities, and their presidents, and the less smaller programs are left with peanuts.

Maybe it's just me,but I think there are more pressing problems to be addressed by this administration,or any other,than this.

I would prefer the NCAA realize the BCS is not popular and the fans deserve better and fix it themselves without Government getting involved. There are far more important issues.

As would I. Don't see it happening though. Too many people stand to lose too much.

Its like figure skating. The judges hold up their score cards at the end of the year.

Because their is billions of dollars at stake and its 2010 and College Football still doesn't have a legit champion.

People who say the NFL is all about the money drive me insane because College is just as bad if not worse.

In the grand scheme, it's not that many people involve who benefit most from the BCS, but otherwise I agree with your assessment 100%.

JMO but the overwhelming number of college football fans want a playoff system inclusing me. Because the presidents of the schools doen't want one the overwhelming number of college football fans including me will forever be disappointed.

The BCS is a joke and I want it gone as much as anyone but the Government needs to keep its nose out it. The government sticking its nose into this is a bigger joke.

This is a precarious thread around here...

My whole issue with "State Schools" is that we pay more and more in taxes every year, but yet tuition goes up three-fold...

What gives?

DII schools host playoffs... and many of them are far more academic than DI schools...

This is the dirty little secret... they drain us for money and claim "academics"... when they could care less about that... it's all about the money...

Not to mention the complete racket that is the college bookstore. Changed the example problems in Chapters 10 and 16? That's going to require a new $160 book. It's really getting quite ridiculous. The knowledge you gain in college is hardly +EV(for all you poker players) anymore if you're a business major. I live in Texas and since the only school I wanted to get my bachelor's from was UT, i got denied(with a 3.2 transfer gpa and 1350 old SAT) and will be attending school out of state for a low sum of $28,000 a year. Great.

I for one am glad that something is finally in the works, it's just sad when the administration has to step in because you're gumming up the works that badly. Of course the BCS and the majority of the prime time schools like the current situation, they get automatic bowl bids every year and if they finish undefeated they're guaranteed a shot at the national championship. I wonder if TCU, Cinci, or Boise enjoy the current the current situation.

The sad part is if something is done I could see the state programs shafting the students out of spite. No millions guaranteed from watching our 5th ranked team in the conference play in the toilet bowl? That's a 50% tuition hike, citizen.

Am I missing something here? I dont understand what the BCS has to do with the cost of tuitition.
