So I have a relative, who is 19, who made a terrible decision and took cash (25 Dollars) out of a cash register where he was employed.

His employer then found out about it and fired him but didn't press charges or anything. My relative even payed back what he took.

Well a couple weeks ago he applies at another place and they were going to hire him until they got something on the OSBI talking about this incident.

My relative didn't even know it was on there and he thought it was a mutual agreement between his previous employer that everything was ok but he still had to go.

So my question is how does he go about getting this removed?

Hes a good kid but just made a really stupid decision and hasn't had any problems at all since this occurrence almost 10 months ago.
 
I ANAL, but you need to look up Oklahoma's expungement stuff.

Ummm you can only expunge an actual crime, i.e misdemenor or even in some cases class c felonies. Since a court of law isn't involved here there is no recorded crime.

Something seems fishy, I highly doubt you can just call them up and give a detail of what happened w/o evidence to back it up and police doing some sort of investigation.

If it is legit and it is on some OSBI background check, I would SUEEEEEEEE.

So if a police report was never filed he can sue for having something like this show up on an OSBI?

Maybe there is something he isn't telling possibly. I don't know why he would hold out though. No reason to.

Im not saying he is holding anything back but the scenario makes more sense to me that he was caught and Police were called and made a report but the owner didn't want to press charges and have the young man arrested.

That report still has to be filed and depending on how Oklahoma handles it, I could see it showing up on his background for some unknown length of time. Typically if that is the case it drops off the check after 6mo or a year. The Police would still have had to inform him of what was involved.

If it were me, I would really press the whole...
