2 years in jail for shooting yourself in the leg?

Great.

Anyone else think it is a little ridiculous? I mean the guy is dumb, no doubt, but he didn't hurt anyone but himself. Yes, he should have registered the gun, but these guys think there above the law- see all of them that drive without licenses...

I find it just amazing.

This isn't ridiculous at all. He got caught, plain and simple. Its a felony and that deserves jail time. Doesn't matter if he hurt anyone, he broke the law and got caught. You have to stupid as s*** to carry a gun without a license like that. (especially not being registered either)

Bit too long, but I guess thats what for carrying a gun illegally and shooting yourself.

Shooting himself had nothing to do with what he got in trouble for. Had he carried the gun legally, he wouldn't have gotten in trouble for shooting himself.

What if the gun had discharged and hit someone else? would 2 yrs have been too lenient. If you are carrying an unregistered loaded weapon into a nightclub, then you are an idiot, and if you shoot yourself(thus letting everyone know you have said weapon) you are an idiot who is going to go to jail. Particularly in Manhattan.

Does anyone know if it is a full 2yrs, or is it 2yrs minus x amount of months for good behavior?

They said it could be reduced to 20 months for good behavior.

The crime was having a loaded gun in a nightclub, not shooting himself. Shooting himself is simply how he got caught and provided undisputable proof to the original crime. NY has these tough gun laws because if they didn't, there would be shootouts on a nightly basis at bars and nightclubs all over the city.

If the gun had discharged and hit someone else, he would have been facing different charges.

This same offense could be charged as a 3rd degree felony in Texas, 2-10 years is the range on that.

Should he try to get the District of Columbia v Heller to apply?

That doesn't sound unusual for any sentence.

How would that apply? He is not being told he does not have the right to own a hand gun. He just never registered the hand gun.

And even if he could somehow apply that case he would have already done it and not pled out.

Now that he has a felony charge on his record can he legally own a gun in the future?

Plax's career is over.

Any GM who signs this guy at 34, after 2 years in jail and his history of discipline problems, should be fired on the spot.

Don't want to go to jail? Don't carry a weapon illegally.

2 years for shooting yourself? That is more than a little harsh. He may have been illegally carrying the gun, but he showed no hostile intent with it. Those are some draconian laws.

I guess McNabb is going to have to wait a few years to play with him.
