Is disorderly conduct even a legitimate criminal offense? I always thought it was some petty offense that they just slap you on the wrist for, maybe throw you in lockup for a night .

After some quick research, apparently it can be considered a criminal offense if it's a misdemeanor. Ridiculous that saying "F the police" war whilrants a jury trial.

From my personal experience; disorderly conduct is the reduced charge for assault/batter and causing public disturbances in restaurants/bars, from being "too" drunk and verbally threatening/confrontational. The court does work with you until they get tired of seeing your face;)

Lets face McClain resisted arrest the man is 6'03" 259lbs in very good shape chances are a lot bigger than the police officer who his trying to do is job. I think when you put a cop in a bad situation then you can expect bad things to come your way

Doesn't sound like he did much.
said on WJZ-AM in Baltimore. "They continued to move people out of the streets when they heard it again. They eventually identified the person in the crowd. They moved in, told him he was under arrest for disorderly conduct, at which at that point, he tried to jerk away."

1st off they came into an area where people were getting out of control and evidently McClain was at the center of it, when they tried to arrest him he pulled away twice

Police officers arrived at Pines Park in response to a reported disturbance, resulting from what witnesses said was somebody spitting on McClain's car, according to Lt. John Crouch, the public information office for the Decatur Police Department.

McClain and others were ordered by police to leave the park after a large crowd gathered. In the process of walking away, McClain allegedly said "[Expletive] the police." Crouch said the comment was audible on the microphone the officer wore.

When he was informed that he was going to be placed under arrest, McClain twice pulled his arms away from the arresting officers, resulting in the resisting arrest charge


Let me say this when police say you are under arrest it is not up for debate they mean it and they are not going to fight you this is not chuck norris and walker texas ranger. If you want to debate it then do it in front of a judge but when people start choosing when they will listen to the police or not then we got a real problem. McClain is not some small guy and they were not asking him they were telling him he was under arrest and had he done as asked he would not be facing this charge. Pretty simple really

I realize he's going to get the charge from it. NY cops killed a guy doing similar. But jerking away, could also be called flinching which should be expected if someone grabs you. It's a far cry from getting physical with the officers.

and this was not a first run in with the law for McClain damn do what you are told if you want to resist then fine do so but it will cost you. I'm tired of guys thinking they do not have to abide by the law fact is they do. Now you are changing what took place? he flinched twice not jerked away from them? lol Too many cops lose their own lives by not following procedure, these men are people too they have families they want to go home to at the end of the night and they are not playing games with people who are breaking the law. Again this was not a request by the police it was an order and if McClain had an issue with it then call internal affairs, file a law suite , tell it to the judge but again had he done what was asked by police he would not be dealing with this BS today.

Why was he being "made aware" for being under arrest when what he said is completely legal.

we will never know since he choose to then resist the police. Chances are your right if all he did was use the F word at the police, you go in front of a judge they say he used the F word and they throw it out or hit him with some small fine, the problem is when he resisted, again you don't get to pick and choose what laws you will abide by.

But that is the main argument here, it was instigated by the police and then to go on to prosecute such a charge smells funny (repeator or not). McClain would not be considered a threat considering the real threats who turnstile through the courts.

There was some sort of altercation people including McClain were asked to leave he choose to say something that lead this, not saying the cops were right but we were not in that situation at that time so we really do not know what the mood of the situation was. Again Mclain was he was placed under arrest chances are he could have gone to court and chances are it would have been dismissed but instead he resisted. And again you don't pick and choose what you will obey with the police you act like a fool they will treat you like a fool.

“It appeared that whoever it was was trying to get the crowd stirred up,” Crouch said. “They eventually identified the person in the crowd, moved in and told him he was under arrest for disorderly conduct. At which point, he tried to jerk away. The officers grabbed his arms, he continued to struggle, trying to pull the officers further into the crowd. They did eventually get handcuffs on him. At that point, they recognized him as Rolando McClain.”

This was not some flich as you put it

Given past conversation I understand you have no respect for police but these guys put their butts on the line every night and they are not playing around. Too many have lost their own lives because they let their gaurd down, they gave McCalin an order he failed to do as he was told. He could have fought this in court and had a good chance to win but you do not resist arrest period.

I think the main problem I have is that police are supposed to conduct themselves above petty instigation. The reason them being there was irrelevant in my opinion. He brought this on his own, and hopefully he learns and matures from this situation. It is not hard to stay out of jail

Yep. I don't feel sorry for him, at all.

He brought this down on himself, having said that you would hope he learns and can move forward. If I was him I would want to get this matter resolved as quick as possiable and move forward with getting my life back in order. I found out a long time ago the change starts with yourself but those who choose to blame others for their situation are doomed to repeat it over and over.

Ahhhh, we are so close to agreement but he has that right to do just that and not a reason to use against him. Not leaving the scene, yes.

it is not a court of law there is a place to deal with it but on the streets with the police it not that place that is how matters get out of hand because guys go off on the police and start acting like a fool, it is a good way to really escalate the problem and he did. I'm not saying the police were right and I'm not saying the loud mouth McClain was right he had the chance to walk away he choose not to and it escalated the problem. You want to challege the police on the streets you will lose.
