I don't believe this is a Texas issue. Couple of points that come to mind.
1. Texas never prevented this person from contacting his his Consulate. He simply did not do it.
2. It is also not the responsibility of Texas to do this. It is the responsibility of our Government to notify the Mexican Government of the situation. Imagine if you will, a call coming into the Mexican Consulate from a penitentiary somewhere in Texas...... Again, not on Texas.
3 I believe that this happened in San Antonio. San Antonio is a Sanctuary City. They don't ask if you are legal or illegal when you get arrested and they don't deport you. How can you advise somebody that they need to contact their Foreign embassy if you don't know they are illegally in the Country?
4. Mexico does not extradite criminals from the U.S. They would rather have the U.S. pay for the expense of incarceration or execution. Even if he had contacted his Government, it wouldn't have mattered because they would not have done anything for him.
5. Lastly, I am not so sure that Mexico was not aware of the fact that this person was here and on death row. Also, does anybody find it, at least mildly interesting that SCOTUS answered the Presidents request to stay so quickly? Perhaps it's because they have already considered this and made a ruling on it. Former President George W Bush also asked that an number of foreign criminals currently sitting on death row in Texas be retried because they were not informed of their right to speak with their Consulate. Among those named in President Bush's request, one Humberto Leal. The same guy who was just put to death yesterday. Bottom line, he had to know that he had the right and the ability to talk to his Embassy. His Country had to know that he was on death row. Our Government knew for years that he was there. They had plenty of time to deal with this issue. So why does this President pick this particular time to ask SCOTUS to do something that was clearly unconstitutional and had already been looked at? Form your own opinions there but it's real hard for me to see how Texas is at fault here.
JMO
