I just view both sides of the situation and make a judgment. I think it's completely short sided to only look at one side. In most cases I don't even relate the two sides. The guys that stole the trailer should go to jail, but that has nothing to do with what becomes of the guy that shot them. He himself committed a crime as defined by the law. So he too is guilty. The difference? Shooting a man is a lot more serious a crime that stealing a trailer.

You know what the irony here is, stealing the trailer is a felony. If the old man's shot had killed the worthless piece of trash the other guy would have been charged with 1st degree murder because his partner in slime died while in the commission of a felony.

Then maybe justice would have been done. In this case they are protecting the turds.

Put me on that jury. That old man never spends a day in jail if I am on that jury. Not one day.

Talk about stupid and a waste of tax payer's money. No one is any jury going to convict an 80 year old man trying to protect his property. Its sickening that this DA is so stupid, hopefully public out cry will help him do the right thing.

I hate to sound racist but the fact that one of them is in our country illegally and not being sent back to where he came from also ticks me off. They will prosecute a guy defending his property but they wont send an illegal back accross the border, last time I checked it was a crime to be here illegally.

No, coming off "sounding stupid" is when you accused me of "backing the thieves" when in fact I never did. You just assumed as much because I pointed out that the guy was guilty of a crime also.

Remember, I didn't make the law that he is guilty of. I only pointed it out.

They got off lucky. I wouldn't have missed and so far they aren't facing charges.

That's the part that irritates me, along with they've been in this country illegally, involved in all kinds of illegal activity and yet are still here.

As far as I am concerned the old man is justified.

You are right. If they were facing charges and prison over deportation, I wouldn't be mad at all.

They aren't, so I am.

When I was 14 I got my wallet stolen by 3 kids at an Albuquerque Mall. I caught one of the 3 and got all but 5 bucks of my money back. I got my 5 bucks worth on him. The cop who came wanted to put me in jail for whipping his butt. They robbed me and the cop wanted to go after me.

To this day stuff like that grinds my gears.

Elderly man facing serious charges for shooting at thieves

WHEAT RIDGE, Colo. - Legal analyst Dan Recht said he believes the Jefferson County District Attorney is "seriously overcharging" a Wheat Ridge homeowner, accused of attempted first degree murder for shooting at two thieves.

82-year-old Robert Wallace said he fired two shots at two men when they tried to run him over while stealing his flatbed trailer.

Wallace now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison.

One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally.

But they are not facing any charges.

Recht said, in his experience, prosecutors overcharge cases to force a person to plea bargain. He argued that it's just not right to put a person through that kind of mental and financial stress.

Jefferson County DA, Scott Storey, indicated he'll take a closer look at his office's decision to throw the book at the homeowner and hinted the charges could be reduced.

I agree. What is being reported is a highly unlikely situation if all the facts have been presented. I'm betting there is a lot more to this. I'm sure it's a lot of very selective story telling to get page views.
