Fans should know CBA rules for contract negotiations

Let me ask you this .......... Parsons filed a lawsuit claiming there is NOT valid agreement ( on a handshake )as Jerry claims. Who has a stronger case?
No one is claiming that there is a valid contract. A handshake contract in this situation would be unenforceable because (1) the CBA requires it be in writing; (2) the statute of frauds requires contracts which cannot be completed within a year be in writing; (3) probably a bunch of other stuff I'm not considering as I type this from the treadmill on my phone.

But it's the principle of the matter that is sticking to Jerry. He and Micah came to a middle ground where everyone would be happy and it would be good for the Cowboys. Agent came in and screwed it up.
 
The player must choose to act on his own behalf. Micah has not chosen to do that. That is the key here. Yes a player may act in his own behalf, but he has officially decided to use an agent.

So the piece from article 48 you have mentioned is not valid unless the player chooses to act on his behalf, which Micah has not.
No, you are creating a defining element not at law, but a tool of your own. No one has lied as to the law involved. If you instead imply that Parsons later chose to listen to total control and negotiation by his agent, that is NOT breaking contract and compliance with the NFL, or Player's Association.

Jerry never took that to court. I don't always listen to my wife as she is sometimes wrong. Parsons still puts risk into HIS next three years and loss of multi-millions.
 
That rule forbids a player from being represented by an agent not certified by the NFLPA. Players may not negotiate their own deal if they have an agreement with an NFLPA certified agent. That’s where Micah is now.

Lamar Jackson represented himself in negotiations with Baltimore. Two MVPs and he’s paid less than Tua Tagovailoa. Smooth negotiator. He’s paid substantially less than Dak Prescott. I’ll bet he secures the services of a certified agent for his next contract.
Show us where it says a player can’t negotiate with a GM/owner, he can but the way I see it a player can but the contract has to be submitted to his agent which it sounds like happened but the agent said no. There’s nothing that says a player can’t negotiate on a contract even one with representation as long as all contract proposals go through tha players representatives as long as he has one.
 
I’m a lawyer, and I deal with contracts every single day in my work. There’s no gray area here. You’re just inventing a rule that doesn’t exist. You started this thread claiming that any and all contract negotiation must go through an agent, but the plain language of the CBA (and years of actual practice in the NFL) show that isn’t true.

If what you’re saying were correct, Jerry Jones and the Patriots would have been punished dozens of times over for talking directly with players about contracts without agents present. That never happened, because there is no such rule. Article 48 simply ensures that if an agent is used, they must be certified. It does not require that an agent be used at all.

It’s strange to me that you’ve made this claim with nothing to back it up, and then doubled down as though it were fact. But the reality is simple: there is nothing in the CBA that supports the argument you’re making.

Many fans saw the appearance of Jerry Jones on Michael Irvin’s podcast today. Saying he had “an offer on the table for Micah Parsons” with sizeable numbers.

JJ saying all that is a total waste of time and a complete misrepresentation of how NFL contract negotiations are to be conducted according to the NFL’s current Collective Bargaining Agreement (CBA)

For example, if an NFL player has an NFLPA-certified agent, (which Parson’s agent David Mulugheta certainly is) then all negotiations must go through that agent. Period. Teams are forbidden from contacting or negotiating with players who are represented by an agent without the agent's presence.

Jerry knows this! Clubs can face penalties for violating this rule, including the cancellation of any contract offer or signed contract made outside of these rules.This rule protects players by ensuring they are represented by their agent during negotiations, helping to prevent situations where a team might pressure a player into a less favorable deal without their agent present. (Imagine that)

So if we hear Jerry or Stephen say that “we had an agreement last March”, it is a completely invalid argument. Apparently meant to win in the court of public opinion in hopes that many Cowboys fans should buy that. Don’t buy it. It’s invalid.
I don't think many people understand that this has always been Jerry's strategy with star players that didn't sign early.

There have been countless stories in the past where the player wanted to be in Dallas bad, Jerry talked directly to the players, dangled an extra benefit they wanted to nudge them and then the players went back to their agents and told them, "Do the deal!"

Agents know about this habit from Jerry just like the media does and fans do, so I would not be shocked at all to hear that every Cowboys player agent warns them pre-emptively about that tactic.

Most players are more business-centric these days and are told in countless meetings by advisers and NFLPA speakers starting the moment they are drafted to let their agents handle everything.

Add to that the fact that a lot more players in college are getting agents for NIL which means they are getting a lot more information and instructions before they ever enter the NFL than they did in the past.

In other words, the old school backroom handshake deals that old people used to make are an antiquated way of thinking and negotiating these days.

I think this is an ace that Micah's agent will hold up his sleeve in case (or when rather) this impacts Micah more directly.

Right now, nothing's changed. The new season has not started and Micah has a contract.

Once the first game gets here, that all changes.

Now, if Jerry gives in to Micah's demands then my guess is nothing will ever come from Jerry bypassing the agent.

If Micah holds out and the Cowboys start fining him, I suspect his agent will file the complaint and use that as leverage to get Micah the contract he wants or a trade to a team where he would want to play.

I think Jerry realizes that the Cowboys are not one Micah away from winning anything this season so paying a defensive player, no matter how great they may be, a huge chunk of the salary cap in a low-expectation season is not very appealing.

The player is free to talk about anything he wants. Climate change, contract extension, the price of eggs. If he has an agent, only the agent can formally agree to contract terms.

The NFLPA strictly enforces it, including restricting the player to using only an agent they certify. The reason why? Idiot owners like Jerry Jones. Jerry doesn’t like being pushed around. Not by the players union or the commissioner. He’s still looking like a fool for the Prescott contract. He doesn’t like that, either.

Doesn't matter what you think is right or wrong, if he's going to play this kind of hardball when he doesn't need to, If he's going to have an ego this big, then he's going to hold up negotiations with this particular team and owner, Then yes he's the problem, I get it Jerry's part of the problem but Jerry's the one writing the checks, jerry's the one that's going to end up paying Parsons and his agent..

Jerry doesn't have a problem with other/most agents, i've already been over this in this thread Why is it since 1989 everybody else has gotten paid without it getting this ugly? No one said what he's doing is wrong but T higgins fired him because he didn't like the way David was handling his negotiations, he felt like it was holding it up and he still got his money with the other agent he This is the problem If Jerry doesn't want to deal with David and Parsons wants to get his money then yes it's the agent that's the problem..


This wouldn't be the first time a player changed agents, i'm not saying he should but this has happened often enough that it's not that rare....

That is the reality that's where we're at jerry doesn't like this agent they're not getting along at all to a point where now they're they've taken this to public to a point where Parsons is caught in the middle but we know both sides whether it's all true or not I'm not taking a side but if this is what's holding up Parsons from playing game one for my Dallas Cowboys then yes The agent is the one holding it up..

Even if it doesn't seem directly to you Jerry doesn't want to deal with him but he's willing to deal with other agents he's willing to pay the money he's paid every single superstar this team has ever had that was supposed to get their money and some that she even shouldn't have gotten their money.

Wrong. The CBA allows a player to negotiate his own contract terms without limitation. Of course it has to be reduced to writing but the agent does not have the final say on a contract.
 
Florio is looking for clicks and attention. If Jerry was violating the CBA, he would be disciplined. Nothing in the CBA prevents Jerry from directly negotiating with Micah. You posting a video where Florio speaks in vague generalities changes that.
Nobody wants to see the truth they want to think Jerry's truly bypassing the agent in which he's not It's that simple All this has to come to is once there is an agreement the agent has to be involved in the final process look it over sign off on it Everyone sign it witness it and then there we are that's all it needs to be done is Jerry cannot force Parsons to get rid of his agent to get paid if he came out and said I don't deal with agents at all and you're gonna do this without an agent or you're not gonna be on my team that would be illegal...

That would break that rule that's not what's happening here talking to a player coming to some kind of verbal agreement is just the contract in principle and in this case the agent doesn't want to even look at it because he's mad at his client for even promising this stuff to Jerry and here we are the two egos they're at a impasse..

It it's kind of odd that this place cannot read what they posted here and come to the same conclusion the players are allowed to talk to the owners in GM's about contracts they just can't be forced to sign one without the agent present the agent would have to approve it and most of the time the client would tell the agent to approve it...

Jerry's done hundreds of these like so many it could be a 1000 contracts I have no idea He's used the agent every time if the player had an agent he doesn't have a problem with most agents he has a problem dealing with this agent....

Jerry may be old school and not like dealing with agents but he does it because it is part of the process it is part of the CBA but he doesn't have to do it at the beginning he just has to make sure they're included in finalizing the deal and approving it and being a witness to it that's it that's the bottom line of that rule you cannot force a player to bypass his agent in order to pay them...

That's not what Jerry's doing jerry does not set it out right but I bet if he went to Parsons and told him get rid of your current agent pick your another agent of your choosing and we'll get this deal done tomorrow.

That's true, but you're twisting the truth again. I'm tired of hearing how you think you're always right and that Parsons and his agent are 100 percent correct—they're not.

Parsons is an employee, and as such, he can discuss a future contract with his boss at any time. They can establish a contract in principle, discussing money, years, and expectations without violating any rules. There's no penalty for that.

Jerry was not trying to force Parsons into signing a contract without his agent present. They had a preliminary agreement, which angered Parsons' agent. The agent intervened, telling Parsons to stay quiet and informing Jerry they were starting from scratch.

This boils down to an ego problem. Jerry has dealt with countless agents and lawyers over the years, involving them in every player deal he's signed or business contract he's completed. They've always followed the law, with lawyers present to negotiate and finalize details.

If there were rule violations, Jerry wouldn't be publicly discussing it, knowing the league would penalize him. You're cherry-picking the rules here. It's true that players can't be forced into deals without their agents, but that's not what happened. For 36 years, Jerry has engaged in preliminary discussions with players and involved agents once the player was ready. In this case, the agent refused, citing his own ego, and rejected any part of the deal.

By the way, to remain consistent, Parsons is the one who publicly had to take this this far....this is about David vs Jerry(goliath) both are wrong...


This doesn’t mean the deal can’t get done because Jerry has plenty of intermediaries and layers of people to handle it for him. Or maybe he’s just pushing Parsons to do what T. Higgins did—part ways with David—and they’ll sign the deal tomorrow with a new agent involved. This isn’t about avoiding agents; it’s about disliking this particular agent. They’ve clashed, and now Parsons is stuck in the middle. Honestly, I don’t even blame Parsons—it seems like he’s getting bad advice.

I’m pretty sure Prescott has an agent, and a pretty prominent one at that. Last I checked, he got two deals done through this agency without resorting to any of these tactics. He didn’t miss practices, OTAs, or camps, even playing on the franchise tag, which is basically the fifth-year option. He never demanded a trade or made a public spectacle. This isn’t about agents in general; it’s about this specific agent. Jerry and his staff have worked with Prescott’s agent recently, as well as those for Osa, Trayvon Diggs, and Steele—they all had agents.

Let’s stop pretending Jerry is trying to bypass agents entirely. He’s just fed up with this one because the agent blew things up, copped an attitude, let his ego take over, and challenged Jerry. And typical Jerry wasn’t going to tolerate it—so here we are.
