The NFL Prosecuted & Convicted Ezekiel Elliott –Will The 2nd Circuit Allow It?

It’s happened. The Ezekiel Elliott case has surpassed Deflategate. For those who never thought it was possible, substance now rules over form.

Why would an off-the-field domestic violence case attract more attention than a football scandal accusing the League’s poster boy quarterback (Tom Brady) of rigging the game? There have been countless domestic violence scandals in football, and none have detracted this much from the sport.

It’s because Elliott’s case is not about his actual innocence or guilt (we may never know what unfolded between him and his ex-girlfriend). Elliott’s case is about his prosecution and conviction by a private corporation.

Read Twitter feeds, Facebook posts, YouTube comments and you will see the clear division. The public is at odds over whether he did it. Some certain he’s guilty and must be punished. Others proclaim his innocence, because he was never criminally charged.

Why is the football world so obsessed with this man’s reputation? Because the NFL has marred it. The NFL has taken a criminal matter and not only injected it into the sport of football, but investigated it, adjudged it and punished it.

The NFL seems to believe that if the criminal justice system fails an alleged victim, it needs to save the day. Some may agree with this notion, given the high profile, high-salaried nature of professional athletes. However, taking on responsibilities such as this comes with consequences.

We do know that Elliott never assaulted Tiffany Thompson. Stop giving her the benefit of the doubt when she has consistently been proven to have lied with eyewitnesses that witnesses those lies and those eyewitnesses include her best friend since 6th grade, her best college friend, law enforcement, co-workers, etc.

If we had called it like it is then there would be enough outrage that Goodell would have never suspended him.

It should have been on the Ravens to cut him, fine him, etc.

you cannot prove a negative and the NFL said that since Elliot could not prove he did not do it he is guilty.

This is exactly what I've been saying for a while. This isn't a typical player rule violation punishment the NFL is trying to enforce. This is them publicly convicting Elliott of a crime, while our legal system declined to even charge him due to questionable or non-existent evidence. Whether allowed by the CBA or not, the NFL has greatly overstepped their authority because this goes well beyond the NFL and affects Elliott's life outside football. In other words, just because a player is a member of a union that negotiated a CBA with their employer does not mean that employer (aka: corporation) has unilateral power to rule over aspects of a player's life beyond football.

This is not a case of a failed drug test suspension leading to a subsequent impact outside of work (football). This is literally the NFL choosing to publicly convict someone for their own profit. This would be no different than your employer writing an article for a newspaper or magazine about you saying you abuse women, and of course they cannot have a woman beater working for their company, so they fired you, without any evidence (that we know of). That is the very essence of defamation of character. When you consider the NFL's motivation for convicting Elliott is their own financial benefit, the legal mess they are creating just gets worse and worse.

Because they are arguing completely from a corporate point of view. They need that indisputable evidence to put on NFL.com as proof as to why they didn't punish him because they fear backlash.

It had absolutely nothing to do with actually objectively evaluating the situation.

They decided that they would make an example of Zeke no matter what the evidence. I really wish we could find a email or something like that stating it. Wouldn't it be fun to see the NFL try to explain THAT?

She claimed that he yanked her out of her car and assaulted her. 6 witnesses said that was not true. And she is STILL claiming that it happened.

The NFL hired two quack doctors that would give them the answers they wanted with regards to the bruising in the pictures that *Thompson* sent to the NFL that were dated the 18th. Not only can metadata being changed, untraced...but Kessler brought a foremost authority on bruises and stated that essentially the doctors' claims were hogwash. One of the doctors ended up admitting that the expert was right. The other doctor lied and said she could not testify because she was going to be hospitalized for a surgery and that turned out to be a lie as she was at home all day. Also the numerous eyewitnesses, some of which had only ties to Thompson and not Elliott...claimed they saw no bruises on her from the week of June 15 thru the 21st. In fact, a co-worker stated that he saw her personally in a bikini that week and she had no bruises on her. She also claimed her best friend since 6th grade would vouch for having a facetime conversation with her and seeing the bruises. This friend told the NFL that was a *lie* and it never happened and she did not trust Thompson anymore.

It's not a case of Thompson claiming that Elliott assaulted her and she didn't have enough evidence to bring this forth for an arrest. It's a case of her accusing him of assault and numerous pieces of evidence, along with eyewitnesses that included *her* friends and co-workers have all stated that what she claimed happened did not occur.

So yes, we DO KNOW THAT HE DID NOT ASSAULT HER. Pretending otherwise to hedge your bets or in fear of possibly being viewed by some nitwit as somebody that somehow supports domestic violence is what has caused this mess to begin with.

If the situation was reversed and it was Elliott that had all of these witnesses that said he did it and had texts of extorting her with a sex tape and had texts of him trying to get his friends to lie to police...we wouldn't be giving him the benefit of the doubt. But, because Thompson is a female people like yourself just can't call a spade a spade and say...yes, she lied about the entire thing and she cannot be trusted.

The public outcry was never there with this case....... they created a year long drama to placate NO ONE....... there haven't been any protests or boycotts and almost no actual coverage of the case

Joe Mixon, Frank Clark, Tyreek Hill all get a free pass because they did it in college but no one cares either...... the NFL is only hurting itself by dragging it out

America has moved on to the Hollywood sex scandals

Just give EE his stay.....let him finish the year and quietly next Spring make a face saving deal with a huge fine and some community service

I don't know that Zeke didn't assault her at some point in the past (How could I?), but that is not really the point. He wasn't charged by the state authorities and the NFL's own investigator found her something other than credible, so I have to regard man as entitled to the benefit of the doubt in the absence of conclusive evidence to the contrary.

I read this article from another thread we have but it holds true no matter what Zeke thread you read. She actually did a great job with this article. I just wish there were many more from others. Not just others but names the NFL knows and respects..... One can wish anyways.... Go Zeke!!!!

She's the worst liar since 'Jackie' from the University of Virginia.

Jackie completely made up the accusation. She caused the school to stop *all* Greek life for the rest of the semester. She caused the Dean of Students...a female...to get demoted when she did nothing wrong. Jackie also cost the school, state and federal government money as law enforcement got involved. The fraternity in question...which wasn't even in town on the date she made alleged the rape happened...was vandalized and branded as rapists.

Yet, they still refuse to give up Jackie's name and there are still people that claim that 'while she lied about this rape, she must have been raped before in her life.'

And so it goes...

I keep saying this and I think it is the crux of the matter. If Zeke were an employee who had no protection under labor laws the NFL could pretty much railroad him, including banning him for life with no evidence whatsoever.

But once an employee has protections under a contract it takes it outside the realm of terminable at will. If there is a procedure in place the NFL must follow it.

Even if Goodell is the judge, jury and executioner they must afford him due process. That is meaningful, substantive and procedural due process. I think it is clear that Zeke was denied that in this case.

That is probably Zeke's best chance of winning the case on the merits. Fairness is just a general term for what is really at issue which is notice and opportunity to be heard. He was denied "being heard" when they excluded certain evidence when it was readily available. That's the NFL's Achilles' heel.

One more thing. Courts are inclined to find "irreparable harm" very readily when no one is hurt by them finding it. Courts would generally rather preserve the status quo if the law allows them to do so and let a case be fully litigated on the merits.

I fully expect the injunction to be entered and Zeke play out this year. I don't know for sure but the smart money is betting on that side of things.

The biggest reservation I have is that the NFL may be able to start this all over and give Zeke due process and then literally drive a truck up his ***. I am not sure they CAN do that, but if they can, Zeke is bought and paid for.

What a well written piece. The NFL is a farce and needs to start managing the actual sport and not all this off the field stuff. It's really getting embarrassing. The Owners should be pissed they've spent so much money in attorneys for something so minuscule.

As the author is making the point, the NFL has no business getting into this business of criminal justice system. I agree with Jerry Jones not because I am a cowboys fan, I criticized him plenty of times, but we have one the best criminal systems in the world and it is called law enforment agencies like Jerry said. If the players are convicted within that system, then NFL should punish them based on CBA. This is another one of Goodell's mess dragging NFL through courts and making it look bad for lot of fans and sponsors. I don't know how the other owners think he is doing a good job

The problem is that because this has garnered so much attention, Elliott has already suffered significant financial impact from the NFL's own criminal court system. Look at the deals Prescott has been signing since his great year last year. Elliott would have been doing the same had this not happened. I cannot see Elliott letting this go if he is truly innocent.
