Brent will appeal decision to delay his reinstatement

Schaffer pointed to the only other recent case involving a player found responsible for DUI resulting in death: former NFL receiver Donte’ Stallworth.

“It was the same exact situation,” Schaffer said. “Both were tragic and unfortunate. Stallworth received a 16-game suspension. I base everything on precedent. The precedent was set. But Josh will serve a 30-game suspension.”

That calculation treats Brent’s placement on the non-football injury/list list and his 2013 retirement as de facto suspensions. While it’s unclear whether the NFL would have suspended Brent in 2013 while he was awaiting trial, Brent’s retirement allowed the NFL to avoid a very delicate situation.

“It’s important that Josh voluntarily retired,” Schaffer said. “He could have forced the NFL to go through a tremendous amount of scrutiny for allowing him to play pending trial or for attempting to suspend him before he had been proven guilty. Where’s the incentive for someone to do that in the future? Giving him twice what Stallworth received doesn’t seem to be acknowledge that.”

I think King Roger will say he tacked on time for the failed drug tests taken by the state.

"They're not letting him go to facility for the first six weeks, but Aldon Smith gets a nine-game suspension and they're letting him show up for work there every day and he went to camp and he played last year, and Josh hasn't played football in almost three years and he needs training camp more than anybody," Schaffer said.

For some strange reason, I do not see Brent being the key cog in a five game stretch run to glory.

Thus, this is of zero consequence to me.

He is right there with the other miracles we appear to be banking on, like Spencer and Lawrence returning to save the day.

by game 10 no telling who might be lining up on defense if you look at last year. might be Brent and some dudes who are bagging grocery or selling tv at best buy

But where you are getting caught up is in the motive for retiring in the first place. Do you think he was the sole proprietor of the decision to retire or do you think it was a wink-nod, gentleman's agreement between his team, the Cowboys and the league office to avoid any fiasco with him trying to play with the situation over him or the league trying to suspend him before the legal process took it's due course?

Judging by his agent's statements about them appealing the ruling, it sounds like the latter. So it is really a 30 game suspension, which is then unfair. I personally think the suspension is going to get reduced and the league is just saving face with this initially stricter suspension in light of the Rice situation and their new efforts to crack down on domestic violence etc
I think that it may get reduced to 8 games, I can't see any less than that.

The NFL conditionally reinstated Josh Brent as a member of the Dallas Cowboys on Tuesday, contingent on the defensive tackle serving a 10-game suspension for his January conviction of intoxication manslaughter.

Brent, who was responsible for the death of Cowboys practice squad member Jerry Brown in a 2012 accident, is eligible to visit the team facility after Week 6. He can begin practicing with the team provided he complies with a list of conditions, including evaluation, treatment and counseling.


If Brent exhibits any alcohol-related conduct or activity, he faces immediate suspension -- or perhaps even a banishment from the NFL.

After the 10-week suspension expires, he will be considered for full reinstatement following an additional report from the NFL's substance abuse program advisors. Brent would not be able to play before Week 12, as the team has a bye in Week 11.

Now 26 years old, the seventh-round pick from the 2010 Supplemental Draft has recorded 44 tackles and 1.5 sacks in 39 career games.

Brent announced last July that he was retiring from football to focus on getting the priorities in his life in order. Now nearly three months removed from his jail term, he wants back in the game.

Cowboys owner Jerry Jones had promised Brown's mother that the organization would not turn its back on Brent, who was a close friend of her son. Against a wave of negative publicity, Jones has held a steady course in supporting a player who would have otherwise been cast out of the league.

UPDATE: Brent will appeal the decision, according to NFL Media Insider Ian Rapoport, per a source close to the player. Earlier Tuesday evening, Brent's agent Peter Schaffer told ProFootballTalk.com's Mike Florio of Brent's decision to appeal.

Josh Brent retired from the NFL in July 2013--two months after failing the tests for marijuana use while awaiting his trial. He was still employed by the Dallas Cowboys and the NFL. Thus, the drug policy was in full effect when he got caught.

Its the reality of the Disney Land in Dallas.....its all about the entertainment industry taking off in CowboyLand......Move over Disney the Cowboys are coming to town....

Really can't remember when the Dallas Cowboys was relevant NFL Football team....

The alcohol use was bad enough. It contributed to Jerry Brown's death. Anyway, the Medical Director already had the alcohol factor to consider. Then, Josh Brent adds marijuana use to the mix while awaiting his trial. Brent's substance abuse weakness was further exposed. I am kind of surprised Brent's suspension was not longer. He could have been kept in Stage One for six months for the alcohol and drug use alone, but I guess everything in his case did not add up to "unusual and compelling circumstances" for the Medical Director and the commissioner.

I think the NFL is protecting the cowboys from themselves.... Man I hate the thought of bringing him back. I've been a loyal fan of this franchise for 40 years. I stuck with them thru the bad years without a 2nd thought but I don't know how much more of this I can take as a fan. It isn't the record. Every team goes thru it and all i ask is that we fight to make it better. It's the decision making. I'm not a fan of Sam and I'm disgusted with the thought of bringing Brent back. These are not the actions of someone who has the best interest of the football team in mind. These ARE the actions of someone who has become a victim of his own entertainment business model. I know, cue all the "Well... bye!" or "go root for some other team then!" or some other such drivel. I was a fan when the Cowboys helped build the brand that is the current NFL brand with Staubach, Dosett, Pearson, Thrill HIll, etc. and I've been a devout fan longer than most people on this board have been alive. Yes I know they had "Hollywood" Henderson as well but I remember, even as a kid, knowing that his lifestyle was wrong (and he will tell you the same today). You didn't have any guarantee's even as a great talent and Brent is not a great talent. Sam is not a great talent. And we've become a media "harlot" for lack of a better term and I'm not sure how much longer I want to sell myself to a team that strives for "relevance" instead of "excellence".
