Then I would suggest you are an argument for gun control, because gun owners have to be aware that, as has been mentioned in this thread before, owning a gun legally does NOT mean it is legal to use it or threaten to use it in any circumstance. Gun owners have to be smart with how they use their guns, otherwise they don't need to own them.

Chasing a guy down and using or even threatening to use it is a crime - more serious than the brick throwing.

Puffing out your chest with a gun in your hand is not the mark of either good judgment or bravery.

This is not a subtle legal distinction here.

If you were getting carjacked or mugged there would be reason to believe your life is in danger - there would be an immediate threat. The law, and common sense, dictates that you be allowed to DEFEND yourself.

Chasing down a kid who is running away from you is not the same. There is no immediate threat to your life or health and you are not defending yourself. This is a kid trying to GET AWAY and avoid a confrontation.

of course I see the difference.... I just wanted to see your reaction.

If the kid wanted to avoid the confrontation he should have used better judgement to begin with! Most people won't go for what he did!

He'd better be glad he only got as much as he did!

The problem is you are thinking with a macho, puffed out chest, gun in hand for protection attitude, and not with your brain.

The law, on the other hand, would throw your *** in jail without hesitating.

The law only allows the use of deadly force in the event that your life or health is in imminent danger - and when a kid is running away from you your life is not in imminent danger.

Your argument that the other guy made you mad and therefore caused you to chase him down and threaten him with and/or use deadly force wouldn't even be laughed out of court because your lawyer would tell you that it would be stupid to even go to court - plea bargain would be the best you could do.

I'm not upset or about to blow a gastket - I'm just trying to tell you that your take on what you can do with a gun is not reality ....... it doesn't take a legal scholar to understand this.

Perhaps you are trying to divert attention away from how goofy your argument was. It's like a little kid claiming he HAD to shoot little johnny in the eye with a BB gun because little Johnny broke is Tonka truck and made him mad.

It doesn't matter if you own a gun - you were defending the use of one in this situation.
