If he is found to be mentally ill, will he still get the death penalty? I don't even see why he did it, normally there is a vendetta like that guy at the school council.

Just judging from the information coming out, I don't think an insanity defense would get very far. If they're finding things he wrote such as targeting Rep. Giffords, "I planned this alone," and the like, he's gonna fry.

He may very well be insane. But the insanity defense is only effective to avoid a conviction (and likely death penalty) if the insanity rendered him unable to realize what he was doing, and that it was wrong.

Just a knee-jerk opinion taken from snippets of information I've seen, so take it FWIW.

Well, I'm not a lawyer but from my understanding for an insanity defense to work, you must be able to demonstrate that the accused didn't know what he was doing was wrong. Since he left a note saying "Please don't be mad at me" he must have known what he was going to do was wrong.

Just to add to what you posted and I just caught a snippet of what an attorney said on Fox this AM..she said they probably would not use the insanity plea because the evidence was strong that he did plan this. Some letter he wrote; some Facebook posting.

I dunno. That mugshot is creepy. It's telling as well that people that had an association with this guy thought he was nuts and would be one to do something like this.

Yep. And it's not just that he may have been legally insane at one point in time. If there was a plan, he would have to prove insanity at the time he developed the plan. Then he would have to prove insanity at the time he carried out the plan. And at all steps in between.

Suffice it to say if the prosecution can prove some kind of planning, it will be very hard for him to be found not guilty by reason of insanity.

Yea you're exactly right. Reading so much on this that it's hard to know what is accurate or not (for instance the other day when I logged on there was a big story online about how the Congresswoman was dead) but apparently he is not talking to the investigators at all. He's definitely not right. The lady in his math class said he was nuts and that was obvious. He looks like evil personified in that mugshot. Creepy.

Regardless of the verdict, he'll spend the rest of his life in a mental institution.

hey i just wanted to pass some news along, a lot of people have been asking what they can do for Giffords so much so that her husband mark asked her and her answer was "nothing" he asked if there was anything she wanted and she said "make a donation to red cross or the food bank, there are other people in need that can be helped". just thought i would pass that along, i believe mark had a press release on this as well.

as for gabby she is doing well all things considered, but is not out of the woods yet and has a long road ahead regardless, please continue to keep her in your prayers

This guy is a complete twit. I have my beef with the government, but you won't catch me using violence against them.

All this did was make politicians, who are already hard to access, nearly impossible to access now because of all the future security precautions.

The alarmists will be out in full-force now. Ironically, he created exactly a situation I believe he was fighting against.

But that's what morons like this do.
