I think that's like hand on his shoulder not running into his torso while your back is towards the ball.

he didn't make contact though, only contact was when he graced his arm after the ball got there

Gee, I thought I had pointed out that they don't call it all the time, and that it's not a black or white rule since it's not called all the time.

The spirit of the rule is to protect the refs. In this case, there was nothing to protect the refs from. There was obviously no malicious intent, the ref wasn't in danger, it was accidental, and so on and so forth. Clearly this is an instance, where any official with any credibility would not throw a flag or eject the player.

And Periera (sp?) has said in the past that the refs should make calls with the spirit of the rule in mind, not always the letter of the law.
