This is actually a win for Zeke. This judge could have denied the petition saying he hasn't exhausted his remedies through the CBA thus giving the NFL the chance to file in New York. Instead he has agreed to hear the arguements and has accepted that time is of the essence to make a ruling before the Cowboys first game.
That's not quite right.
This isn't about exhaustive remedies. It's about preventing injury.
The NFLPA will have cited that by setting a hearing for the injunction it ensures that Elliott can hear an appeal without injury. The NFL still has the ability to suspend him any time they want. Elliott can't get missed games back.
And the NFL can't file in New York. They have to wait for the NFLPA to file a motion against them and then try to have the proceedings moved to NY.
He agreed to hear the motion for the injunction before the first game.
I don't know this is the reason behind it as it may be because Monday is a holiday, but I remember seeing that Henderson has to rule on Elliott's appeal by Tuesday at 4:00pm EST or otherwise Elliott will be eligible to play in the Giants game. So, I'm guessing that the 5PM time is to give the NFL Appeal process time to complete before the courts actually rule on it. A decision will likely be made prior to that time, but the court will probably sit on it until the NFL's Appeal process has been completed (which I believe is required by the CBA) via the announcement of Henderson's ruling. If Henderson rescinds/vacates the suspension, the court order will likely be shelved. You ever thought otherwise? Big business has never been an angelic process. Ever. Almost all of our largest businesses are where they are by unscrupulous practices to undermine and destroy people and/or competition- righteousness be damned.So much for Henderson being "unbiased"....he obviously has a price that was met........otherwise, the lead investigator that spoke with the ex concluded as well as law enforcement that there was nothing to it, much less that warranted a suspension.
The NFL has really regressed since Goodell started playing commisioner.
They didn't wait for Brady to file. They filed in their court of preference asking the judge to confirm their right to suspend Brady.

Ezekiel Elliott suspension put on hold by court
The NFLPA's request for a temporary restraining order to block the suspension of Dallas Cowboys running back Ezekiel Elliott has been granted by the Eastern District of Texas.
NFL arbitrator Harold Henderson had upheld the six-game suspension for violating the league's personal conduct policy. The NFLPA's filing called for the court to vacate any suspension of Elliott, accusing the league's appeals process of being "fundamentally unfair" and citing new facts revealed during this week's hearing that wrapped up Thursday.
Elliott can now potentially be allowed to play while the case works its way through the courts.

Um, it's common knowledge that the NFL filed a lawsuit right after Brady's appeal was denied keeping them from filing in their choice of courts. If you don't already know this then you didn't pay attention. Try google.

This wasn't a lawsuit. They filed to have the court affirm the action of Goddell.
