Have you read ANY of the information provided about what he did wrong and the fines for each? Seems like you missed it.

• Operating While Under the Influence
• Possession of Open Intoxicants in a Motor Vehicle: A $267 fine issued after deputies found an open bottle of alcohol on the passenger side while inventorying his Jeep to be towed.
• Unsafe Passing on the Right - A $235 fine
• Refusing to Take an Intoxication Test - could result in a 1 year suspension

After watching everything we've seen and all the evidence that's out there.
I don't believe that Tony was impaired enough to be a hazard on the road or unable to drive from what I saw in the test they gave him.
He walked a line he stood on one foot he just didn't do things exactly the way they asked him but he was stretching and doing other things that people wouldn't do if they were drunk.

That said he may have had a few and been over the legal limit but does anybody believe he was too impaired to drive from what they saw in the videos

Yeah sorry but I don't want anyone out there who's "had a few" thinking they can drive and risking things. Would he have made the judgement to go over the line that got him stopped in the first place if he hadn't had a few? The stop was a little sloppy but he should have to pay whatever price there is for driving after drinking and hopefully it discourages him from doing it in the future like the laws are designed. The fact that he's a public figure and risking it makes it a double bad judgement.

1) She DID tell him multiple times that she smelled booze on him. He didn't argue or say he disagrees, which is telling because he verbally disagreed with other things (like when he kept reiterating that the shooters in his bag were unopened).

2) He failed all of the tests miserably by not even being able to follow the simple instructions.

How could she smell anything? The wind was whipping on that bridge.

Maybe one of the 5-6 cops in the garage smelled it?

Some amazing BBQ joints in Toronto as well, and some popping up in the Burbs where we are. Lots to do in Montreal if you have a few nights, lol

He had alcohol on his breath and apparently there was an open container in the car. If it was a warm day, the windows were rolled up and the A/C was distributing the smell all over the car. So if he rolled down his window to talk to her it would be impossible NOT to smell something. Come on now.

Refusing the breathalyzer makes it worse, in my opinion. Even though the tests aren't 100%, why refuse if you weren't under the influence? But he also lost track of time and directions, had an open bottle, and passed unsafely. There's simply too many factors that add up to suggest he was fine to drive.

he actually performed poorly on all three FSTs

Even a sober person can fail them, but his performance was not good.

HGN - There are two instructions. Follow the stimulus with your eyes and don’t move your head. He was able to do neither.

Walk and Turn - he failed to put heel to toe one time. He started too soon. He stoped once completely. His balance was off and he complained about their being “too many instructions” despite interrupting.

One-leg stand - he held his hands out to his side. His balance was poor. He didn’t do it for the duration so they actually stoped the test short.

Passenger side, back seat, doesn't matter. The smell would waft its way through the vehicle. We don't know if Romo hid it over there once he knew he was being pulled over. Remember, Romo expressed confusion about the cop being on the loudspeaker so it's possible he didn't pull over right away. Who knows if he was buying time so he could hide the bottle there, you know?

Someone posted that on X under the banner "Tony Romo DWI video." Based on the title I was fully expecting him to see a dude who was sluring his words etc. Nope just an unhinged cop that has no judgement. Insanity, just absolute instanity.

I've seen more unsafe passing on the Northeast extension of the Pennsylvania turnpike then I want to talk about and I don't think all those people were drunk just impatient.

Yep....it's all a bit strange. "Intoxicated". "Impaired". What is that? LE has put an arbitrary number (typically .08 but as low as .02 BAC), as if everyone reacts the same to it. Then the have the field sobriety tests which are (obviously) subjective.

If I was Tony, I'd ask my lawyer about the original reason for being pulled over. If he did something wrong THERE, why didn't he get a citation for that too? Because he didn't. Sus.

Yes I definitely believe circumstances alter cases and a
230 lb football player can probably have a couple beers without becoming too impaired to drive a vehicle whereas 110 lb gymnast may experience much more drastic effects from the same amount of alcohol .

In my mind from what I saw he did not look too impaired to operate a vehicle just my opinion.

Driving isn't a right. Passing on the right unsafely is against the law. That's the reason he was pulled over. They smelled booze. He failed tests. They found an open bottle.

People leave all kinds of things in their vehicles.

What I would like to know is how much alcohol was in his blood at the time of the incident and if the amount of alcohol that was in his blood would make a man of his stature to impaired to drive a vehicle.

In my mind being over the limit by some infinitesimal amount and actually being impaired to the point where you couldn't drive safely are two different things.

I want to know if Tony was putting people in danger by being crazily over the limit or did he just have a couple beers and was fine to drive .

Nope, and it’s an especially strange name choice because Boston has no signature pizza style or even a reputation of having decent pizza. Unlike NYC, Chicago, Detroit, New Haven, etc. I’m guessing they just wanted a generic American sounding name.
