He would be a fool to do that.
It would be funny if this arrogant man pushes the suspension until late in the season and he misses a playoff game.

I hope he stops acting like a big spoiled crybaby. I actually respect his game and hate to watch him continue to make himself look like a brat.

Reports are stating that Judge Berman doesn't think much of the NFL's case, so Brady has a chance of serving no games at all.

Shouldn't the same apply to Greg hardy? I read that part of the problem with the NFL investigating players is that it removes the players rights to Due Process.
Hardy was not convicted when he had the right to Due Process yet the NFL convicted him anyway and served as the judge, jury, and executioner.

Reports are simply that - reports. Nobody except the Judge and probably his clerk or clerks know what he is thinking of ruling.

Trying to read into what a Judge is thinking based on questions asked or statements made in a courtroom is ridiculous.

Maybe he pushed it back to the soft spot of the schedule and then lets the matter drop. Sitting the four 'easiest' games but guaranteeing he's there for the meat of the season. Jets-Dolphins-Skins-Giants, maybe? Or maybe Skins-Giants-Bills-Broncos, since that's just one division game in the bunch?

Just a(n) (admittedly crazy) thought.

With the official efforts to settle the Tom Brady suspension litigation over (the unofficial efforts, in theory, may continue until a decision is reached and beyond), the question now becomes how Judge Richard M. Berman will rule. That question has several potential answers.

It’s important to remember that no one knows what will happen. People will make predictions, guesses, whatever. Anyone who claims to know precisely what the outcome will be is lying or uninformed.

The goal for the remainder of this post is to make you informed about the options Judge Berman has.

First, he can give the NFL a slam-dunk victory. That would entail upholding the suspension in its entirety, refusing to stay the suspension pending appeal, and forcing Brady and the NFL Players Association to make an immediate effort to persuade the U.S. Court of Appeals for the Second Circuit to grant an injunction allowing Brady to play pending the appeal.

Kessler would easily be able to manipulate the timing of things. He could - if he wanted to - easily stall and delay things several weeks. The expedited process of this current round is the exception, not the rule.

Right. Because Goodell DID follow the CBA.

My view is that the NFL will prevail - not because the court feels the arbitration is fair - but because it is what exists per the collective bargaining agreement which the NFLPA bargained for.

the nflpa agreed that deflating footballs gets you four games? maybe conduct detrimental to the league, but again, it's really just circumstantial evidence. not being helpful in an investigation being worth four games wasn't agreed upon either.

No - the NFLPA agreed to the arbitration process.

And that's also the problem: no guidelines were negotiated or collectively bargained. The NFLPA's one failure, in this regard, is not demanding a black-and-white standard for application of the rules for player discipline.

Granting an injunction would only happen if Brady loses the appeal and then files for an emergency injunction.

Those are very hard to get. He has to show that he will probably win on appeal and that he would be irreparably harmed if he had to miss 4 games.

It is still anyone's guess but the burden was on the NFLPA to win the case, not for the NFL to settle.
