One of my least favorite Cowboys of all-time.

Nein!
Surely there are otters we can least like.

Take Ratliff and his alleged ailments and eventual defection for example.
At this point Orton is just a punk who is getting under our skins. I am sure jerra the businessman half a plan to git him and git him good.
Go jerra, in this we are all behind ya!

Good info. But here's my question: What is the next step? Is there a point where Orton will be forced to pay that sigining bonus back or could this stand-off go on until the Cowboys need to make space on the roster when they make their final cuts following preseason or be forced to continue to hold a spot for a no-show on the roster?

If Orton retires the Cowboys can try to recoup 3m of the 5m signing bonus they gave him in 2012. The wouldn't get the money or cap space until 2015 at the earliest and it would come in 1m increments over 2015-2017.

If they cut him, they save his 3.25m salary in cash money and cap space. They would take a 1.1m cap hit this year and have a 2.2m cap hit in 2015.

If he fails to report for mandatory workouts and camp, they can start fining him everyday.

If he reports and looks like a malcontent, they can always just cut him.

There really isn't an reason to do anything for a while since they are already 10m under the cap and they don't need the roster spot until after camp.

It may be more about the actual cash and not the accounting for it. No matter how much money Jerry has, 3 million is still a lot of frickin money.

If you cut the player, then the player keeps the money...isn't that what the player wants and so therefore he wins?

Yes, but he already won when you wrote the roster bonus into his contract.

The real question is, how does it affect the team seeing that a player can not report for anything and not get cut?

And he can be relegated to the emergency QB slot on gameday...
Just what he'd like. Full checks and never having to play.

I believe the mistake is your assumptions that Jerry has already messed up. In any case, mandatory is not voluntary as you've incorrectly stated before.
Like I said, the roster bonus was apparently the mistake. Not that I blame Jerry so much if there was no previous indication of this attitude from Orton but still.

And apparently nobody got the D-Ham "voluntary" reference.

But he actually earned that money. They paid him 7.2m for 2012 and 2013. That is the going rate for a top backup QB. Jerry admitted he was overpaying for Orton and getting money back is really just overkill.

I suspect that the players don't even care if it's someone else not showing up and getting fined by the day. It's not their money that they are losing out on or playing time for that matter. I mean realistically if it were me and you at the workplace, would you care if I didn't show up to work and not getting paid/or money being taken away from me?

Just what he'd like. Full checks and never having to play.

Is any different than what he did last year? Your paying for an insurance policy on Romo that you never want to cash in if your in the hunt.

Who knows what the real story is with Orton and quite frankly who really cares other than Jerry trying to recoup his money back. The way I see it, if you are seeing Orton on the field that means that Romo is done and more than likely the season with it. Weeden is getting all the reps and may be something to develop if it carries into camp and preseason.

The D-Ham reference would have been better suited if this were OTAs but now we're into the mandatory stuff. I guess bad timing?

Begin the process of fining him and make sure that the league is fully aware of everything that's going on so that when you go after the money from THIS guy (unlike Ratliff), you GET IT BACK!

Right.

This is matter of contract law, and every owner in the league has an eye on this and similar disputes, especially cases like the Ratliff crap. You can bet that there are some collective legal opinions on the proper current course, and deliberations on future contract details which would prevent an owner from getting fleeced.

I think we all feel a bit of anger if someone fails to honor an agreement, but it will occasionally happen. Sometimes you need a good lawyer to protect your interests, and Jerry has several. You think he wants to get fooled again endure another mutiny? And the league hates it, too.

It will play out over time in Jerry's favor.

I'm thinking this is exactly the process they are going to follow. I've read in a couple articles that they don't want to repeat the Ratliff situation. And in this case, this situation is pretty clear cut. Fine him to the Netherlands until he shows up. And if he shows up with a bad attitude, document everything and establish grounds for conduct detrimental suspension.

Both sides entered the agreement with good intentions, now he doesn't want to honor it. It's a simple matter of coming to some sort of settlement so that both parties can move on. He can retire, but he's gotta give back some cash.

Agreed.

maybe he was just on a banger and woke up late????
fine him daily any time that you can that he is not in a mandatory session...let that take a hit from his beer money....then, even if he does show up, you make him the 4th of 5th QB in taking reps in TC...let it leak out that he is going to the PS once camp breaks if he makes it that far, then he gets cut on the last day that he can be cut...you recoup as much of the money through fines as possible....of course, if he just wants to do nothing and collect his paycheck, then that would fall right into his lap...but, I would NEVER let this guy take a snap behind center again if he is just playing the team...

No, the point on Hambrick was that he made his infamous comment after not showing up for a -- yes -- voluntary workout and what did the team do? They promptly cut him because of his attitude.

And that was under Campo.

So now Orton doesn't show for mandatory workouts and they say everything's fine? Not very good message IMO.

Now maybe he retires tomorrow and this all goes away, but if he does the minimum and gets paid his 3 mil+ salary as a guy who doesn't even want to play, I don't think that's worth it just to save Jerry some money.

Also, funny to read that players don't pay attention to what happens to other players when for a couple of years there cutting even good solid pros like Andre Gurode was supposedly Garrett delivering a huge get-tough message to the rest of the team.
