Pretty much. That’s how it works with HR.

You’d have to basically prove this was a false claim . Or at least taken in the wrong context.

And any video , circumstantial evidence or other testimony provided along with any of your own personal history can go against you.
And in this case it's Irvin who is suing. The woman and the hotel are the ones being legally accused of wrongdoing. Burden of proof is on the plaintiff.

Irvin is not facing any legal consequences nor was he fired. Both of those things could change, however.

And if he was fired the liability would go against the company not necessarily the plaintiff .

It’s up to the Marriott to determine if this accusation holds merit .

The employee didn’t hold any authority herself in removing him from hotel or suspend his coverage at SB.

I profile them like I would anyone with history as such. Been around athletes all my life . Most jocks like this are used to getting away with just about anything .

And I was pretty much right about how the Elliott situation would unfold and play out .
being right about Zeke's outcome was hard? BUt you were not right about Zeke. He has been a model citizen since that happened. They wanted Zeke's head on a platter, no matter what evidence or lack of they had.

wrong, wrong, wrong.. HR would have to show that Irvin violated the terms of his contract. HR WOULD HAVE TO SHOW, not Irvin prove he didnt. In the end, The NFL Network can do anything they want and then it would be up to Irvin to go to court to show they violated his contract.... and this case you are also talking about damaging his reputation. So if Irvin could show the NFL Network damaged his career with no proof of wrong doing, he could sue for lost future earnings. But, why do you think Irvin has not filed any suit against the NFL Network??????? Because as of today he has no case against them as he is still getting paid.

why should Mike's background matter but not his accuser? and based upon the fact this little interaction was between 45seconds and miunte, there is NOTHING he could have said that should cost him his career... NOTHING. The FACT is he didnt touch her, he didnt intimidate or threaten any violence against her... so please get off the end a man's life over a 45 second interaction.

Im sure she cant sleep at night and has suffered PTSD due to what Mike said......smh

Nope. Irvin's side needs to:
-Prove she lied/exaggerated
-Prove the hotel knew she lied/exaggerated
-Prove the hotel then told NFL Network with the express intent of damaging his career
and it doesnt appear to me this will be hard to do based upon what we DO KNOW right now.

wrong again... if he is fired over this it would be because of the accusation made against him... BY THE EMPLOYEE. You can sleep easy knowing she would also be held responsible if he were to win any suit against the hotel as it was the accusation that got this rolling. Just know if I were involved in this case as any lawyer and you were in the jury pool, I better get you dismissed first day during selection as you have never seen a case that involved some accusation of a woman against a man where you were ready to hang the man the second the accusation was made.

Has it occurred to anyone that the alleged victim may have been victimized in the past? And understandably jumped to the wrong conclusion? We all have histories that influence our present. We simply don't know either of them well enough and we haven't walked a mile in their shoes. So I am not judging anyone.
That's not an excuse at all.

Your trauma is not justification to falsely accuse someone of something. Sort that out with a shrink if it's that bad.

He lost a lot of money, because he was pulled from SB coverage and an appearance on ESPN's First Take. Technically not fired, but for all intents and purposes, it's the same thing.

So I can just lie to someone's employer about that person, get them fired, and not worry about any consequences whatsoever?
What is stopping a woman from walking into a store, telling the manager one of his employees grabbed her there, and walking out? She doesn't have to prove anything.

If I go to my HR department and say a supervisor runs a hostile work environment, they don't even tell the supervisor my name. If enough people do this, that person could be fired. He could then sue the company, but I, or those that accused him never have to prove anything.

Since we do not know anything about this woman, her job title, her tenure or what she reported to her supervisor, that may be the evidence for the hotel, the word of an employee.

I don't think he lost a lot of money, he's an employee of the NFLN, not piece meal contract labor. Don't know about ESPN's compensation.

But security may see evidence in his denying even talking to her and then using I can't remember. He did not even defend himself when questioned.

You really do struggle with logic LOL are you the one that claims to have the criminal justice degree? If so that's shocking. My point was is there are those claiming that Irvin's past doesn't matter but these are the same people that will say the women's history matters. I'm pointing out the hypocrisy and you have been proving my point. As to the 45 seconds you have to be clueless to think something couldn't be said in those 45 seconds that could be considered harassment, intimidation, a threat or inappropriate. The fact that you use that as exoneration shows that you probably failed your criminal justice course if indeed you took one

But what if Marriott didn’t respond as they did with the complaint?

I’m sure there’s been countless complaints that Marriott didn’t respond in such fashion.

We don’t even know what the complaint was. It was Marriotts decision to take action. I can’t imagine her having much liability here.

That’s right. NFL network can do whatever they want. That’s what I’m saying. Their HR ultimately has the power . And yes they are liable for that decision.

My argument about Zeke being suspended held up. Just because he hasn’t had any public sexual misconduct since we don’t know if he’s been a model citizen or not.

I’m sure he was a model citizen with all of the other altercations . If be wasn’t a Cowboy , their fans would have bashed him.

Yes, I worked with companies during my career and setting up direct billing when sending a lot of employees was standard and the hotel preferred it as it stremmlined the check-in/check-out for them.

You asked if I know how anything works and while that is insulting, I do not know how everything works. The Thermos bottle is still a mystery to me.
It's a vacuum.

I guess you miss my point. Point being I dont care what he said.... he could have said something completely sexist, completely uncalled for.... and it still shouldnt cost him his career. We just now live in a world that is so quick to say a person said this or said that and they should never be able to work again. So listen carefully.... NO MATTER WHAT HE SAID, it shouldnt cost someone a career. Would it make him a jerk? Maybe. Someone you wouldnt want to hang out with? Maybe... but nothing he said would be criminal. He isnt her boss. He is not in a position of power over her. You should understand the difference and why one would be illegal, and the other nothing more than a pig.
