Possible Loophole In Vick Case...

Hey guys I found out a little something from one of my fraternity brothers....what are your thoughts to this:

Vick could get out in less than a year because of a loophole in the system. Mike Vick is planning on entering the prison's Residential Drug Abuse Treatment Program (RDAP) - an intensive substance abuse treatment program which qualifies eligible graduates for a one year sentence reduction. It's been said that Vick has already requested to be admitted to the program.

So therefore, the story gets even better for Vick because he entered prison before his sentencing date, his release date will likely be pushed up even further. Not to mention that with credit for good behavior and the RDAP sentence reduction, Vick may even be out by the beginning of next year's NFL season.

This all makes sense especially the early entry part and the positive test on the marijuana (when he knew he would be tested)........I mentioned this in the NFL Zone, but I figured it would be a hot topic in the Fan Zone....Sorry Mods;)

He probably will get some time off, but not next year season. You're forgetting the PETA factor ;) It would be a PR nightmare.

Vick isn't incarcerated because of substance problem so I don't see how RDATP can reduced his sentence.

I was thinking that same thing however he still failed a drug test which played a part in him getting sentenced 23 months. It wasn't necessarily because of him funding the whole thing. Vick had no priors...unlike his comrades...

Last time i checked PETA didnt run the US Justice system. If there is a law in the books that says admission ot that program equates to a reduction in sentence then it means he gets it.

I hope he does cause its entertaining to watch all the disingenuous indignation.

Vick is getting what he deserves. You guys can pity him all you want but I don't care if the guy plays another down in the NFL or not.

I think you're underestimating the power of public outcry. Also, I don't think these things are automatic. Isn't there some panel involved in sentence reduction? If so, then the PETA factor comes into play.

Not to mention this is federal sentencing guild lines not state so this ideal he is going to get out any sooner is a pipe dream

This is probably a pretty good guess at the rules of the program.

Anyone gotta link to this RDATP stuff??

While it's up to the state and the judge, he can get credit for time served with the feds.

I think his failed drug test played small part in his sentencing, probably smaller than his lies to the court. Perhaps he'll get small reprieve but I don't see him being out by beginning of next season.

Its more like never underestimate people's attempts to will something to be true. This is very cut and dry. The system exists and if he gets into it then he gets a reduction in his sentence. This is despite whether you, PETA or anyone else doesnt like it.

Now Im usre that there is some sort of committee that reviews these sorts of things but I am also sure that they are given guidelines by which to determine admittance. If Vick meets those guidelines then he gets in. Simple.
